1940
An Act to amend an act concerning weights and measures; and to repeal certain sections of the Code of Virginia relating to livestock auction markets.
An ACT to provide for the addition to the primary system of State highways, for certain purposes, of certain roads, on and adjacent to the lands of the Virginia Agricultural and Mechanical College and Polytechnic Institute.
An ACT to provide for the regulation and control of the manufacture, sale, advertising of and traffic in certain foods; to define adulterated or misbranded food, and to prohibit the manufacture and sale of and traffic in such food; to confer upon the Commissioner of Agriculture and Immigration and the Board of Agriculture and Immigration certain powers and duties with respect to certain foods, and to authorize certain injunctive relief to restrain, and to provide penalties for, violations of certain provisions of this act.
An ACT to amend and re-enact Section 111, as heretofore amended, of Chapter 342 of the Acts of the General Assembly of 1932, approved March 26, 1932, and known, designated and cited as the Motor Vehicle Code of Virginia, relating to the size of vehicles and loads.

An ACT to amend and re-enact Section 19 of Chapter 449 of the Acts of the General Assembly of 1922, approved March 27, 1922, relating to loans by credit unions.
An ACT to amend and re-enact Chapter 401, Acts 1936, approved March 30, 1936, as amended, relating to the licensing and regulation of persons engaged in picking peanuts by machines, so as to transfer to the county agents of the several counties the powers and duties heretofore vested in and imposed upon commissioners of the revenue by the said act.
An ACT to amend and re-enact Section 914 of the Code of Virginia, relating to the condemnation and quarantine of cattle affected with tuberculosis or Bangs disease, so as to allow the State Board of Agriculture or State Veterinarian, in lieu of immediate slaughter of Bang’s disease reactors, to enter into certain agreements with owners of herds.
An ACT to amend and re-enact Section 6454 of the Code of Virginia, as heretofore amended, relating to liens of landlords and farmers for advances to tenants and laborers.
An ACT to create a commission for the supervision of the production and distribution of certified seed; to prescribe its powers and duties; to provide for the appointment and qualifications of its members, secretary, chief, and other personnel, of the field force, and clerical assistants; to provide for the procurement of certified seed stocks, selection of producers, adoption of standards, the regulation and purification of seed stocks; to prohibit certain acts and activities relative to production and distribution of seeds; to prescribe penalties; to provide for the expense of administration; to incorporate herein the substantial provisions of Chapter 370, Acts 1936, approved March 28, 1936; and to repeal said act.
An ACT to amend and re-enact Sections 19-n and 21, and Section 22 as heretofore amended, of an act entitled “An act to provide a new charter for the city of Richmond.”
An ACT to amend and re-enact Chapter 167, as amended, of the Acts Of 1938, approved March 17, 1938, which made certain special provisions as to certain kinds of dogs in certain named counties, imposed certain prohibitions relative thereto, prescribed certain license fees, and imposed certain penalties:
An ACT to amend and re-enact Section 879 of the Code of Virginia, relating to the inspection of certain plants and the issuance of certain inspection certificates, so as, among other things, to authorize, under certain conditions, certain plants to be shipped into Virginia under certificates not issued in Virginia and to authorize the Commissioner of Agriculture and Immigration to seize, treat or otherwise safely to dispose of, or to cause to be so seized, treated or disposed of, certain infected or infested plants and materials; and further to amend the Code of Virginia by adding thereto two new sections, numbered 870-a and 882-a, defining the terms “nursery” and “nursery stock”, heretofore defined by Rules and Regulations, and authorizing the Commissioner of Agriculture and Immigration to enter into certain reciprocal agreements.
An ACT to relieve the owners and operators of motor vehicles, trailers and semi-trailers used for agricultural or horticultural purposes from certain requirements of law with respect to registering and licensing such vehicles, under certain conditions, to prescribe the rights and duties of the owners, lessees and operators of such vehicles with respect to fuel tax refunds, and to repeal provisions of law inconsistent with this act.
An ACT to promote, protect and develop the livestock industry in this State, to prescribe that the standards prescribed by the United States Department of Agriculture for the inspection and grading of beef be adopted by the State of Virginia; to provide that all beef requisitioned by the institutions or instrumentalities of the State shall be on United States Government grades; to provide for an inspector or grader of such beef and for payment of his compensation and expenses; to provide for payment of fees for such inspection or grading and to require certain reports.
An ACT to amend and re-enact Section 1258 of the Code of Virginia, as heretofore amended, relating to commission merchants.
An ACT to amend and re-enact Sections 19, 20, 21 of an act entitled "An Act to reorganize the administration of the State government in order to secure better service, and through co-ordination and consolidation, to promote economy and efficiency in the work of the government; to create and establish or continue certain departments, divisions, offices, officers, and other agencies, and to prescribe their powers and duties; to abolish certain offices, boards, commissions and other agencies, and to repeal all acts and parts of acts inconsistent with this act to the extent of such inconsistency."
An ACT to amend and re-enact Section 549-a of the Code of Virginia, relating to pine seed trees, so as, among other things, to make its operation statewide, to increase the size of trees required to be left, under certain conditions, and to reduce the penalty prescribed for violations.
An ACT to require a special license for hunting deer and bear in Bath county and to provide that fees collected for such license shall be used for the payment of damages to crops and livestock by deer and bear in said county.
An ACT to amend the Code of Virginia by adding a new section numbered 4440-a, prescribing the punishment for the larceny of certain rubber tires or tubes.

An ACT to amend and re-enact Section 7, as amended, of Chapter 212 of the Acts of Assembly of 1932, approved March 26, 1932, providing for licensing dealers in motor fuels, levying a tax upon motor fuels, et cetera, Section 7 relating to refunds of taxes paid on motor fuels.
An ACT to repeal Chapter 16 of the Acts of Assembly of 1919, approved September 4, 1919, relating to trespassing animals in Clarke and Warren counties, and Chapter 97 of the Acts of Assembly of 1923, approved March 24, 1923, amending Chapter 16 of the Acts of Assembly of 1919 as to trespassing animals in Warren County.
An ACT to amend and re-enact Section 2, as amended, of Chapter 114 of the Acts of Assembly of 1924, approved March 7, 1924, relating to agricultural seeds, and to further amend such chapter by adding thereto a new section numbered 2-a, defining hybrid seed corn and regulating its sale.
An ACT to amend and re-enact Section 32 of the Game, Inland Fish and Dog Code of Virginia, as amended, relating to fees for certain permits.
An ACT to amend and re-enact Section 3194 of the Code of Virginia, relating to relief of oyster planters from rent under certaim circumstances, so as to broaden the scope of the provisions for relief.
An ACT to authorize the Commission of Game and Inland Fisheries to harvest and sell timber from its land under certain circumstances.
An ACT to amend and re-enact Section 5985, as amended, of the Code of Virginia, relating to exemptions from jury service.
An ACT to authorize the Commissioner of Corrections to furnish prison labor for farm work in certain emergencies.
An ACT to amend Section 860 of the Code of Virginia so as to change the corporate name and style of “The Board of Visitors of the Virginia Agricultural and Mechanical College and Polytechnic Institute” to the corporate name and style of “Virginia Polytechnic Institute”.
An ACT to amend and re-enact Section 859 of the Code of Virginia, as amended, relating to the Board of Visitors of the Virginia Polytechnic Institute.
An ACT to amend Chapter 394 of Acts of Assembly of 1938, designated as the “soil conservation districts law’, approved April 1, 1938, by adding two new sections numbered 8-a and 8-b, relating to the purchase, operation and maintenance of machinery and other equipment suitable for engineering and other operations incident to soil conservation and other purposes of the State Soil Conservation Committee, and making an appropriation.
An ACT to authorize the Commissioner of Agriculture and Immigration, who may act through the State Entomologist, to inspect, treat, remove or destroy trees having Dutch elm disease, which is declared to be a public nuisance; to make it the duty of the owner of the land on which such diseased trees are found to treat or to destroy them; to make it a misdemeanor for any person to interfere with or hinder the persons making such inspection, or treating, removing or destroying the diseased trees; and to require the owner thereof to pay the expense of their removal, treatment or destruction, and to provide for appeal from orders of officer.
An ACT to amend and re-enact Chapter 167, as amended, of the Acts of 1938, approved March 17, 1938, which made certain special provisions as to certain kinds of dogs in certain named counties, imposed certain prohibitions relative thereto, prescribed certain license fees, and imposed certain penalties, so as to extend the territorial scope of the Act.
An ACT to require a special license to hunt deer or bear in Wise and Buchanan counties, and to provide that fees collected for the license shall be used for the payment of damages to crops and livestock by deer or bear in the several counties.
An ACT to authorize the county school board of Frederick county to lease certain public school property to the War Food Administration.
An ACT to amend and re-enact Section 2, as amended, of Chapter 129 of the Acts of Assembly of 1936, approved March 9, 1936, known as the Motor Vehicle Carriers Act, relating to certain exemptions from operation of act.
An ACT to continue the Marine laboratory under the name of the Virginia Fisheries Laboratory and provide for its operation, to provide for the appointment of an advisory group in connection with such laboratory, and to prescribe the duties and functions of the group when appointed.
An ACT to amend and re-enact Section 8-a of the Tax Code of Virginia, relating to different rates of levy on certain kinds of property, so as to authorize the governing bodies of counties to make certain other classification of certain kinds of property and to impose different rates of levy thereon.

An ACT to amend and re-enact Chapter 355 of the Acts of Assembly of 1944, approved March 30, 1944, authorizing the killing of deer damaging crops in certain counties so as to extend the application thereof.
An ACT for the relief of James Arnold.
An ACT to provide that certain classifications of eggs sold or offered or advertised for sale shall have certain defined characteristics; to provide how such characteristics may be determined; to prohibit the sale of certain kinds of eggs; to provide how certain kinds of eggs shall be marked; to prescribe penalties; and to repeal all acts and parts of acts inconsistent with this act.
An ACT to enable the Virginia Conservation Commission to render scientific forestry services to private timberland owners for a fee, and to render forestry advice free of charge; and to appropriate funds to carry out provisions of this act.
An ACT to amend and re-enact Section 1 of Chapter 82 of the Acts of Assembly of 1938, approved March 8, 1938, relating to the composition of the Virginia State Planning Board.
An ACT to regulate the labeling, sale, and offering for sale of agricultural and vegetable seed; to impose penalties for violations; and to repeal certain statutes relating to the same subject.
An ACT to amend and re-enact Section 74 of the Game, Inland Fish and Dog Code of Virginia, as amended, relating to compensation for livestock and poultry, killed or injured, and treatment of rabies.

An ACT to define and regulate the manufacture, sale, transportation, distribution and use of economic poisons and devices, including insecticides, fungicides, rodenticides and herbicides, and to prescribe the powers and duties of the Commissioner of Agriculture and Immigration in connection therewith; to provide penalties for violations; to appropriate funds; and to repeal Chapter 477 of the Acts of Assembly of 1922, approved March 27, 1922, and all amendments thereto, relating to the same subject.
An ACT to authorize certain produce market authorities to acquire by purchase, lease or condemnation, real estate necessary for its corporate purposes, which real estate may be located within or without the corporate limits of the city for which it is established; and to provide that any such market authority may be located either within or without such city.
An ACT to repeal Section 549-a of the Code of Virginia, as amended, and Chapter 413 of the Acts of Assembly of 1942, approved April 4, 1942, the section of the Code and act respectively relating to pine seed trees; to amend the Code of Virginia by adding a new section numbered 549-a 1, relating to pine seed trees.
An ACT to amend and reenact Section 1240 of the Code of Virginia, relating to the sale of Commercial feeding stuff.
An ACT to regulate the production, handling, distribution and sale of milk, cream and certain milk products; to define certain terms, prohibit certain acts and provide penalties for violations; to provide for the administration of the act and the making of certain rules and regulations; and to repeal Chapter 155 of the Acts of assembly of 1934, approved March 24, 1934, and all amendments thereto, relating to the foregoing.
An ACT to amend and reenact Section 23, as amended, of Chapter 216 of the Acts of Assembly of 1924, approved March 14, 1924, relating to bottles used for sale of milk and cream.
An ACT to amend and reenact Section 3 of Chapter 268 of the Acts of Assembly of 1920, approved March 19, 1920, relating to the board of directors of the Virginia Truck Experiment Station.
An ACT relating to tobacco; to create the Virginia Bright Flue-Cured Tobacco Commission and to prescribe its powers and duties; to promote the sale, consumption and exportation of Virginia bright flue-cured tobacco by providing for campaigns at education, advertising, publicity, sales promotion and research; to levy an excise tax on certain tobacco in Virginia, to provide for its collection, and to appropriate the revenue derived from it; and to provide penalties for violations of this act.
An ACT to authorize the use of an outline map of the State of Virginia, and to authorize the use of an outline map of the State of Virginia and a shield of the United States on agricultural and other food products; to prescribe their uses; to vest certain powers with reference thereto in the Director of the Division of Markets and the Commissioner of the Department of Agriculture and Immigration; to prescribe penalties for the violation of this act; and to provide for receiving as prima facie evidence in any court of this State certificates issued under authority of this act, under a Federal statute and this act, under a similar act of the Legislature of any State, under a Federal statute and a similar act of the Legislature of any State or certificates issued under the authority of a Federal statute relating to the inspection of agricultural products, and to repeal Chapter 255 of the Acts of Assembly.
An ACT to amend and reenact Section 1 of Chapter 315 of the Acts of the Assembly of 1942, approved March 30, 1942, relating to exemption of certain vehicles from certain requirements of law with respect to registering and licensing such vehicles under certain conditions.

AN ACT to amend and reenact §§ 3-82, 3-83, 3-89, 3-95, and 3-116, of the Code of Virginia of 1950, concerning the registration of commercial fertilizers, and providing a new method for paying inspection fees.
AN ACT to amend and reenact § 28-186 of the Code of 1950 to provide for acquisition and the replanting by the Commission of Fisheries of the shells of certain oysters.
AN ACT to amend and reenact § 8-501 of the Code of 1950 relating to bringing bees and certain used bee equipment into the State.
AN ACT to amend and reenact § 46-826 of the Code of 1950, relating to maximum permitted width, height and length of motor vehicles and projection of loads on same, and exemptions so as to broaden the exemption.
AN ACT to repeal § 3-284 of the Code of 1950, which continued § 1400 through § 1443 of the Code of 1919, relating to inspection of flour and other commodities.
ACT to amend and reenact § 28-128 of the Code of 1950, relating to assignment of oyster planting grounds to riparian owners.
AN ACT to transfer the jurisdiction and control of certain parcels of land through and along the Virginia Truck Experiment Station in Princess Anne County from the Board of Directors thereof to the State Highway Commission, and to authorize the latter Agency to use said parcels of land as a part of State Highway Route Number 13.
AN ACT to amend and reenact §§ 8-209, 8-210, 3-211, 3-218, 8-214 and 8-215, of the Code of 1950, and to amend the Code by adding a section numbered 8-218.1, the amended and new sections relating to the labeling, sale and offering for sale of agriculture and vegetable seeds
AN ACT to amend and reenact § 58-841 of the Code of 1950, so as to change the tax levied on peddlers.
AN ACT to amend and reenact §§ 58-846 and 58-852 of the Code of 1950, relating to peddlers to dealers or retailers, who taxable, and limitation of exemption, respectively.
An ACT to amend the Code of Virginia by adding a section numbered 3-630.1, providing an optional method for the payment of certain inspection fees; to authorize the Commissioner of Agriculture and Immigration to permit persons to use such methods; to prescribe the procedure therefor; to provide for revocation of such permission; and to impose certain penalties for violations.
AN ACT to direct the Virginia Advisory Legislative Council to study certain statutes relating to the seafood industry; and to appropriate funds.
An Act to amend and reenact § 13-265 of the Code of 1950.
An Act to create a State Seed Potato Committee and to prescribe its powers and duties; to authorize the adoption of certain rules and regulations; to provide for the inspection of certain potatoes and the certification thereof; to impose certain fees; to prohibit certain acts and provide penalties for violations; and to repeal certain acts.
AN ACT to add a new section to the 1950 Code of Virginia, designated as § 8-140.1, to provide for the operation of a lime grinding plant in Bland County, Virginia, by the Director of the Department of Welfare and Institutions to employ convicts; to sell lime and by-products; and to retain the proceeds therefrom for the operation of the plant.
AN ACT to prohibit commingling of burley tobacco; to define methods of sales on loosefloors; to prohibit the dissemination of false information; to designate the Commissioner of Agriculture and Immigration to enforce this law; to authorize the promulgation of rules and regulations; and to provide penalties for the violations of this law or valid rules and regulations promulgated hereunder.
