1940
An ACT to authorize and empower the Governor to execute in the name of the Commonwealth a deed conveying, subject to the jurisdictional limitations and reservations contained in Section 19-a of the Code of Virginia, to the United States of America two parcels of vacant and unappropriated land containing twenty-three and six-tenths acres and thirty-seven and six-tenths acres, respectively, situate in Rocky Knob Area in Patrick County.
An ACT to appropriate the sum of $5,000.00, or so much thereof as may be necessary, to be used by the Virginia Conservation Commission in connection with the proposed establishment by the United States in Tennessee, Kentucky and Virginia of the ‘Cumberland Gap National Historical Park’, and to confer upon the said commission certain powers in connection with such proposed park.
An ACT to amend the Code of Virginia by adding thereto a new section numbered 2854-a, authorizing the governing bodies of the several counties to acquire necessary lands for certain sewage disposal purposes at county seats, by eminent domain proceedings or otherwise.
An ACT to authorize and empower the Virginia Conservation Commission to execute, jointly with T. Venable Owen and others, a deed or deeds establishing a definite boundary line or lines between the Gallion State Forest and the lands of the said T. Venable Owen and others.
An ACT to add to the primary system of State highways certain roads in the several State parks, and to add to the secondary system of State highways certain roads leading from State highways to public school buildings.
An ACT to authorize counties, cities and towns to acquire lands for the growth of trees and to administer the same, as well as lands now owned by them, as public forests; and to authorize the Virginia Conservation Commission to furnish certain nursery stock and technical assistance to such counties, cities and towns under certain conditions.
An ACT to authorize and empower the Virginia Conservation Commission to convey to the former grantors thereof, their heirs, devisees, assigns or successors in title, certain lands in Smyth county acquired by the said Commission as a right of way for a road from Lee Highway to Hungry Mother State Park, and no longer needed for such purpose.
An ACT to provide for the respective jurisdictions and powers of the United States and the Commonwealth of Virginia over lands in the Shenandoah National Park acquired by the United States, the effect of which is to modify the jurisdiction ceded to the United States over certain parts of said lands as set forth in Section 7 of Chapter 371 of the Acts of 1928, and over other parts as set forth in Section 19-a of the Code of Virginia.
An ACT to provide for better sanitation in and around Hampton Roads; to provide for and create the Hampton Roads Sanitation District, in which shall function the Hampton Roads Sanitation Commission, and other sanitation districts and commissions in said area; to declare the necessity therefor and benefits thereof; to provide the boundaries of said districts; to appropriate $50,000.00 for each year of the biennium beginning July first, nineteen hundred and forty to the Hampton Roads Sanitation Commission for the purpose of carrying out the provisions of law applicable thereto and paying obligations of the Hampton Roads Sewage Disposal Commission; and to repeal an act approved March twenty-seventh, nineteen hundred and thirty-four, and an act approved March twenty-seventh, nineteen hundred and thirty-six, as amended, both with respect to Hampton Roads Sewage Disposal Commission, and an act approved March thirty-first, nineteen hundred and thirty-eight, with respect to Hampton Roads Sanitation District.
An ACT to name the bridge across New River, on Route 8 of the State Highway System, at Glen Lyn, in Giles county, the Andrew S. Rowan Bridge, and to name the bridge across East River, on said Route 8, at Glen Lyn, the Mary Porter Bridge.
An ACT to amend an act entitled ‘“‘An Act to provide for a new Charter for the town of Farmville.”, approved February 10, 1890, by adding thereto a new section numbered 11-a, empowering the town council to acquire, maintain, control and dispose of certain property for certain recreational purposes and other public uses, under certain conditions.
An ACT to authorize the State Board of Education, in consideration of the closing of certain streets in the town of Farmville, to convey to the said town of Farmville for the purpose of opening a new street a certain tract or parcel of land in said town now a part of the property used by the State Teachers College at Farmville.
An ACT to amend and re-enact Section 13 of an act entitled ‘An Act to incorporate the town of Windsor, in the county of Isle of Wight.’
An ACT to authorize and direct the State Highway Commission to take into the secondary system of State highways certain roads in and adjacent to the Prince Edward State Forest, the Surrender Grounds State Forest and Cumberland State Forest under certain conditions.
An Act to appropriate the public revenue for the two years ending respectively on the thirtieth day of June, 1941, and the thirtieth day of June, 1942, to prescribe the provisos, terms, conditions and provisions with respect to the items of appropriation, and their payment, and to repeal all acts wholly in conflict with this act, and all parts of all acts inconsistent with this act to the extent of such inconsistency.
An ACT to authorize the Virginia Conservation Commission, with the approval of the Governor, and subject to certain conditions, restrictions and reservations, to lease to responsible organizations or groups of individuals certain lands or other properties held by it or under its supervision and control, and to grant certain easements over, upon and across such lands or other properties.
An ACT to provide a new charter for the town of Holland, in the county of Nansemond, and to repeal the charter provided for said town by chapter 1047 of the Acts of the General Assembly of 1899-1900, approved March 7, 1900, and all amendments thereof, or of any part thereof.

An ACT to provide a new charter for the Town of Kenbridge, in the County of Lunenburg, and to repeal all acts or parts of acts in conflict therewith.
An ACT to appropriate money for the construction of a building in the Town of Big Stone Gap, in Wise county, in which to house a collection of museum pieces which Honorable C. Bascom Slemp has offered to donate to the Commonwealth of Virginia; to provide that said appropriation shall not become available unless and until certain conditions are complied with; and to accept the offer of the said C. Bascom Slemp in the event of such appropriation being made available.
An ACT to authorize the Town of Big Stone Gap, in the County of Wise, to donate and convey to the Commonwealth of Virginia, or some agency thereof, a portion of one of its public parks as a site for a State supervised museum, under certain circumstances, and to make contributions toward the upkeep of such museum.
An ACT to amend and re-enact Chapter 573 of the Acts of 1926 entitled “An Act to regulate the parking of vehicles in the Capitol Square, and to protect the grass therein.”
An ACT to authorize the Board of Supervisors of Spotsylvania county to convey to the United States of America, or any agency or instrumentality thereof, a certain parcel of land constituting a part of the road running between the National Cemetery to the Park Service Building, adjacent to the City of Fredericksburg.
An ACT to regulate the operation of trailer camps and trailer parks and the parking of trailers, in certain counties of the State, and to impose penalties for violations of the provisions of this act.

An ACT to provide a new charter for the Town of North Tazewell, in the County of Tazewell, and to repeal all acts or parts of acts in conflict therewith.
An ACT to amend and re-enact Section 19-e of the Game, Inland Fish and Dog Code of Virginia, relating to the licensing of blinds for hunting migratory waterfowl and prescribing conditions for the use to be made thereof.
An ACT to amend and re-enact sections 19b, 28, 28a, 80 and 105 of an act entitled an act to provide a new charter for the city of Richmond, approved March 24, 1926, as heretofore amended, and to amend said act by adding thereto seven new sections numbered 63a, 63b, 63c, 63d, 63e, 96a and 96b so as to provide for leave of absence for officers and employees of the city of Richmond serving: in the military and naval forces of the United States of America, the production of books and records of taxpayers for examination by assessing officers of the city of Richmond for the purpose of enforcing the tax and revenue laws of the State and ordinances of the City of Richmond, the refund of taxes and charges erroneously assessed by the city of Richmond and paid and the exoneration from the payment of unpaid erroneous assessments and the assessment of omitted taxes, penalties and interest, the creation of a separate department of the government of the city of Richmond to secure and promote public health and sanitation and to prescribe its powers and duties.
An ACT to provide a new charter for the City of Martinsville; to validate certain contracts and obligations of the said city; and to repeal all acts or parts of acts in conflict with this act, and all former charters of the city of Martinsville.
An ACT to authorize the boards of supervisors or other governing bodies of certain counties to acquire lands for the establishment of parks, play-grounds and other recreational facilities, and to issue bonds for such purpose; and to prescribe the conditions upon which such bonds may be issued, sold and redeemed.
An ACT to authorize the State Highway Commissioner to accept from the United States, or any department or agency thereof, grants of land upon which the United States has constructed any recreational waysides ; to contract with the United States, or any such agency, to maintain and operate same out of any funds available, and to authorize the Highway Department to establish, construct, and maintain similar recreational waysides.
An ACT to amend and re-enact Section 61, as amended, of the Motor Vehicle Code of Virginia, said section relating to reckless driving, so as to require all vehicles to come to a full stop whenever a school bus is taking on or discharging passengers, and to provide that violation of certain laws shall constitute reckless driving.
An ACT to amend and re-enact Section 1 of Chapter 238 of the Act: of the General Assembly of 1940, approved March 27, 1940, relating to fishin; on Sunday in certain counties.

An ACT to amend and re-enact Section 1, as amended, of Chapter 15 of the Acts of Assembly of 1927, approved April 11, 1927, relating to zoning in certain counties, so as to make certain change or changes as to the scope of the act.
An ACT to authorize and empower the Commission of Game and Inland Fisheries to grant to Virginia Electric and Power Company certain easements of right of way across the State Game Farm in New Kent County, Virginia, for the construction, maintenance and operation of electric transmission lines.
An ACT to ratify the action of the Governor of Virginia and the Chairman of the Virginia Conservation Commission in entering into a compact with the Commonwealth of Kentucky and the State of Tennessee relating to the establishment of the Cumberland Gap National Historical Park, and to authorize the Virginia Conservation Commission to carry out the provisions of said compact.
An ACT to provide a new Charter for the Town of McKenney, in the County of Dinwiddie, and to repeal all acts or parts of acts in conflict therewith.
An ACT to amend and re-enact Section 56 of the Code of Virginia, as amended, relating to the location of cemeteries, to provide that the prohibitions and restrictions as to location or establishment of cemeteries shall not apply to the Woodbine Cemetery in Harrisonburg nor to any residence in Norfolk County separated from the proposed cemetery by a State highway, river, creek, tributary branch or marsh lands, if such residence is not less than two hundred fifty feet therefrom at its closest point.
An ACT to authorize the Virginia Conservation Commission to use for repurchase from the United States the lands formerly a part of the Seashore State Park such sum as may be received from the United States as a result of the condemnation of certain lands in the Seashore State Park for use as a part of Fort Story, in Princess Anne County, Virginia, and to appropriate to said Commission, to be used for such purposes, any moneys received for said lands so condemned.
An ACT to authorize the Virginia Conservation Commission to accept from the Trustees of the Slemp Foundation, created by the will of the late C. Bascom Slemp, a collection of books, printings, and museum pieces, to be known as the “Southwest Virginia Museum”; to operate the same with funds donated by the said Trustees, or others, for that purpose; to enter into agreements with the State Library Board for joint operation of said museum and a public library, and to appropriate money for the purchase of a building in which to house said museum and carry on said activities.
An ACT to amend and re-enact Section 79 of the Motor Vehicle Code of Virginia concerning the use of highways and streets by pedestrians and permitting cities of more than sixty-five thousand population to adopt ordinances regulating the use of certain highways and streets by pedestrians.
An ACT to amend and re-enact Section 3388 of the Code of Virginia, as amended, relating to when clerks’ offices shall be kept open, and when they may be closed.
A Joint RESOLUTION proposing amendment to Section 183 of the Constitution of Virginia.

An ACT to authorize the Virginia Conservation Commission to convey certain land to Arlington County, Virginia; and to prescribe the limitations imposed upon and reservations incident to the conveyance of such land.
An ACT to transfer the jurisdiction and control of a certain parcel of land in Marion, Virginia, from the State Hospital Board to the State Highway Commission and to authorize the State Highway Commission to use said land for a residency headquarters lot or other highway purposes and to provide that the jurisdiction and control of said land shall revert to the State Hospital Board when the land is no longer needed for highway purposes.
An ACT to provide a new charter for the town of Middleburg, in Loudoun County, Virginia; and to repeal all acts or parts of acts in conflict herewith.
An ACT to amend and re-enact Chapter 40, Acts of 1927, relating to driving any vehicle over or upon, and to injuring or destroying, any equipment of any fire company, under certain circumstances, making any such action unlawful and prescribing penalty, in certain named counties, so as to include certain other county or counties.

An ACT to amend and re-enact Chapter 364 of the Acts of 1944, approved March 31, 1944, relating to the expenditure by the Virginia Conservation Commission of moneys received from the United States as a result of the condemnation of certain lands in the Seashore State Park for use as a part of Fort Story.
An ACT to amend and re-enact section 5 of Chapter 31 of the Acts of Assembly of 1944, approved February 17, 1944, relating to the recordation by clerks of courts of certain information with respect to persons inducted into the armed forces of the United States.

An ACT to provide a new charter for the Town of Wachapreague
An ACT to amend and re-enact Chapter 21 of the Acts of Assembly of 1928, approved February 18, 1928, relating to what roads included in Patrick Henry Highway.
An ACT to provide a new charter for the Town of Clintwood, in the County of Dickenson, and to repeal the charter provided for said town by Chapter 616 of the Acts of Assembly of 1893-4, approved March 3, cig and all acts amendatory thereof, or of any part thereof.
An ACT to authorize the governing body of any county to prescribe hours and times when certain public dance halls shall not be kept open; a to prescribe penalties for violations.
An ACT to authorize the counties of Warwick, Elizabeth City and York, the Cities of Newport News and Hampton, and the Town of Phoebus, or any two or more of them, to create a commission, to be known as the “Grandview State Park Commission” for the purpose of establishing and operating a State Park and park facilities for public use, for such counties, cities and towns and the general public at large until such park and facilities shall be transferred to the Virginia Conservation Commission for operation; and to prescribe the rights, powers, duties and functions of such commission when so formed and of the counties, cities and towns for which such commission is created.
An ACT to amend and re-enact Chapter 106 of the Acts of Assembly of 1927, approved April 18, 1927, relative to construction of certain walkways adjacent to certain parts of highways of the State Highway System, so as to extend and enlarge the authority of the State Highway Commission in this regard; and to repeal Section 4732 of the Code of Virginia, as amended, and Chapter 133 of the Acts of Assembly of 1938, approved March 12, 1938, relative to the same subject matter.
An ACT to authorize the State Highway Commission to construct and maintain platforms, walkways or other facilities for the use of persons desiring to fish from bridges in the State highway system.
An ACT to amend and re-enact Sections 3, as amended, 3-a and 6 of Chapter 161 of the Acts of Assembly of 1926, approved March 17, 1926, relating to the powers and duties of the governing bodies of certain counties with respect to sanitary districts, and the manner of holding elections in such districts.
An ACT to amend and re-enact Section 30 of Chapter 94 of the Acts of the General Assembly of 1934, approved March 7, 1934, and known, designated and cited as the Alcoholic Beverage Control Act, so as to provide for local option in certain towns upon the question shall the sale of beer and wine be permitted in said town; and to provide how and when said election may be held.

An ACT to validate proceedings under an ordinance of the Common Council of the city of South Norfolk, Virginia, to discontinue and vacate an unnamed street extending from the intersection of Chesapeake Avenue and Chesapeake Drive to Seaboard Avenue.
An ACT to amend Chapter 217, as amended, of the Acts of Assembly of 1918, approved March 14, 1918, and being the charter of the city of Clifton Forge, by adding a section numbered 23-a authorizing purchase or condemnation by council of land within or without the city for certain purposes and under certain conditions.
An ACT to amend and reenact Section 23 of Chapter 280 of the Acts of Assembly of 1932, approved March 24, 1932, and providing a new charter for the city of Alexandria, by empowering the city manager to employ department heads and by authorizing the council to make grants in aid of the Alexandria Bicentennial Commission.

An ACT ‘to provide a new charter for the town of New Market, in Shenandoah County, Virginia; and to repeal the existing charter of the town and all other acts in conflict herewith.
An ACT to amend and reenact Section 4, as amended, of Chapter 96 of the Acts of Assembly of 1872-1873, in force February 21, 1873, which incorporated the town of Lebanon, in Russell County, the section relating to powers of the council of the town.
An ACT to amend and reenact Sections 3162 as amended, 3197, 3249, and 3265 as amended, of the Code of Virginia, the sections relating to fishing, fish and shellfish, and the Commission of Fisheries; and to further amend Code of Virginia by adding thereto a new section numbered 3202-a providing for the closing and opening of natural oyster rocks for settling.

An ACT to amend and reenact Sections 1 and 3, as amended, of Chapter 573, Acts of Assembly of 1926, approved March 31, 1926, relating to parking of vehicles in the Capitol Square, so as to reserve certain areas for parking and to confer jurisdiction as to violations of the Act.
An ACT to provide a new charter for the town of Pembroke, in the county of Giles.
An ACT to constitute the Board of Regents of Gunston Hall a corporation; and to prescribe the powers, duties and functions of the corporation so created.
An ACT to amend Chapter 173 of the Acts of Assembly of 1946, approved March 12, 1946, which authorized the creation of Grandview State Park Commission and conferred upon it certain powers and duties, by adding a new section numbered 3-a, conferring certain additional powers upon the Park Commission.

An ACT to amend and reenact Sections 5222-b, 5222-c, 5222-d, 5222-e, and 5222-f of the Code of Virginia, and to further amend the Code of Virginia by adding thereto two new sections numbered 5222-j and 5222-k, the amended and new sections relating to the subdivision of lands, authorizing regulations providing for public improvements on lands to be subdivided, and providing for the enforcement of the requirements of the chapter and to except certain counties from the provisions of this act and of pter 211-A of the Code of Virginia.
