An Act to amend and reenact § 32-858 of the Code of Virginia, relating
to the issuance of birth certificates upon court order establishing date
and place of birth.

Be it enacted by the General Assembly of Virginia:
a That § 32-353 of the Code of Virginia be amended and reenacted as
ollows:
§ 32-353. Any person born in this State prior to June fourteen, nine-
teen hundred twelve, as to the date and place of whose birth there is no
record in the office of the State Registrar of Vital Statistics and who can-
not produce evidence to the satisfaction of the Registrar as to the date
and place of his birth and such other information as the Registrar requires
to record the birth, may have the date and place of his birth established
by any court of record of the county or city in which he resides or in which
his birth occurred, upon satisfactory proof thereof before * such court or
the judge thereof in vacation; upon * such proof the court or judge shall,
by an order entered of record in the common law order book of the court,
set forth the date and place of the person’s birth as so proven, together
with the sex, height, weight, color of hair and eyes, and any distinguishing
physical mark or characteristic of * such person.
Upon the entering of the order, the clerk of the court shall promptly
transmit a certified copy to the State Registrar of Vital Statistics, who
shall record it in his office, and from which record so made, the Registrar
shall issue a birth certificate to the person the date and place of whose
birth is established by the order, setting forth in the certificate the source
of the information upon which the certificate is issued.
