CHAPTER 225
An Act to transfer the provisions of Article 6 of Chap 9 of Title 88 of
the Code of Virginia, as such provisions were in force prior to any
amendment thereto or repeal thereof effected by the General Assembly
of 1952, and which provisions are contained in §§ 88-808 to 88-815,
inclusive, of such Code, to Chap 7 of Title 2 of the Code of Vir-
ginia, and to renumber such provisions as §§ 2-64.1 to 2-64. 8.
1. That all the provisions of Article 6 of Chapter 9 of Title 38 of the
Code of Virginia, as such provisions were in force prior to any amend-
ment thereto or repeal thereof effected by the General Assembly of 1952,
and which provisions are contained in §§ 38-308 to 88-315, inclusive, of
such Code, are hereby transferred to Chapter 7 of Title 2 of the Code of
Virginia, and are reenacted and renumbered as follows:
§ 2-64.1. Registration of names, buttons, badges, etc.—Any associa-
tion, lodge, order, fraternal society, beneficial association, or fraternal and
beneficial society or association, historical, military, or veterans’ organi-
zation, labor union, foundation, federation, or any other society, organi-
zation or association, degree, branch, subordinate lodge, or auxiliary
thereof, whether incorporated or unincorporated, the principles and activi-
ties of which are not repugnant to the Constitution and laws of the United
States or this State, may register, in the office of the Secretary of the
Commonwealth, a facsimile, duplicate, or description of its name, badge,
motto, button, decoration, charm, emblem, rosette or other insignia, and
may, by reregistration alter or cancel the name. (Code 38-308).
§ 2-64.2. Application for registration.—Application for such regis-
tration, alteration, or cancellation, shall be made by the chief officer or
officers of such association, lodge, order, fraternal society, beneficial asso-
ciation, or fraternal and beneficial society or association, historical, mili-
tary, or veterans’ organization, labor union, foundation, federation, or
other society, organization, or association, degree, branch, subordinate
lodge, or auxiliary thereof, upon blanks to be provided by the Secretary
of the Commonwealth. (Code 38-309).
§ 2-64.3. Registration for benefit of associated branches, etc.—Such
registration shall be for the use, benefit, and on behalf of all associations,
degrees, branches, subordinate lodges, and auxiliaries of such associa-
tion, lodge, order, fraternal society, beneficial association, or fraternal and
beneficial society or association, historical, military, or veterans’ organi-
zation, labor union, foundation, federation, or other society, organization,
or association, degree, branch, subordinate lodge, or auxiliary thereof, anc
the individual members and those hereafter to become members thereof,
throughout this State. (Code 38-310).
§ 2-64.4. Record of registration—The Secretary of the Common.
wealth shall keep a properly indexed record of the registration provided
for by § 2-64.1, which record shall also show any altered or cancellec

§ 2-64.5. Names, badges, buttons, etc., must not be imitative.—Nc

association, degree, branch, subordinate lodge, or auxiliary thereof, having
a name, badge, motto, button, decoration, charm, emblem, rosette, or othe
insignia, similar to, imitating, or so nearly resembling as to be calculatec
to deceive, any other name, badge, button, decoration, charm, emblem
rosette, or other insignia whatsoever, already registered pursuant to th
provisions of § 2-64.1. (Code 38-312).
§ 2-64.6. Certificate of registration—Upon granting registratior
as aforesaid, the Secretary of the Commonwealth shall issue his certificat
to the petitioners, setting forth the fact of such registration. (Cod
38-313).
§ 2-64.7. Penalty for illegal use—-Any person who shall wilfull;
wear, exhibit, display, print, or use, for any purpose, the badge, motto
button, decoration, charm, emblem, rosette, or other insignia of any sucl
association or organization mentioned in § 2-64.1, duly registered under
this article, unless he or she shall be entitled to use and wear the same
under the constitution and by-laws, rules and regulations of such asso-
ciation or organization, shall be guilty of a misdemeanor, and, upon con-
viction, shall be punished by a fine not exceeding one hundred dollars,
and, in default of payment, committed to jail for a period of not to exceed
sixty days. (Code 38-314).
§ 2-64.8. Fees.—The fees of the Secretary of the Commonwealth
for registration, alteration, cancellation, searches made by him, and cer-
tificates issued by him, pursuant to this article, shall be the same as
provided by law for similar services. The fees collected under this article
shall be paid by the Secretary of the Commonwealth into the State
treasury. (Code 38-315).
