Chap. 34. An ACT to authorize the State Highway Commissioner of Virginia
to convey to Gertrude C. Rubin a certain parcel of real estate in Albemarle
county no longer needed for highway purposes. [fH B 29]

Whereas the Commonwealth of Virginia secured by inadvertence,
certain real estate in Albemarle county from W. E. Duke, Mary Duke,
and Helen R. Duke, as executors of R. T. W. Duke, Jr., deceased, by
deed dated the twentieth day of August, nineteen hundred and thirty-
six, and recorded in deed book two hundred and thirty-two, page
five hundred and ninety-four, in the clerk’s office of Albemarle circuit
court, which said strip of land is more fully hereinafter described; and
Whereas the executors of R. T. W. Duke, Jr., deceased, have
heretofore secured equitable title in said strip of land which was not
needed for highway purposes, and have conveyed all of their right,
title, and interest therein, to Mrs. Gertrude C. Rubin, and have re-
quested that title to said land may be conveyed to said Mrs. Gertrude
C. Rubin as hereinafter set out; now therefore,
1. Be it enacted by the General Assembly of Virginia, That
the State Highway Commissioner be, and he is hereby authorized and
empowered in the name and on behalf of the Commonwealth of Vir-
ginia, to convey to Mrs. Gertrude C. Rubin, by appropriate and proper
deed, all of the right, title and interest of the Commonwealth in and
to the strip of land that the Commonwealth of Virginia obtained by
inadvertence from the executors of R. T. W. Duke, Jr., deceased, which
said strip of land is described as follows:
Beginning at a point on the centerline of route twenty-nine between
one and seven hundred sixty-seven one-thousandths miles north of
intersection of route two hundred and fifty and eight hundred ninety-
two one thousandths mile north of intersection of route two hundred
fifty shown on plans as station fifty-seven plus naught naught; thence
north forty-five degrees twenty-eight minutes east, forty-three feet
to station fifty-seven plus forty-three, being beginning of road con-
nection; thence to the left on a fifty-nine degree thirty-three minutes
curve, one hundred twenty-seven and eight-tenths feet to station fifty-
eight plus seventy and eight tenths equals station fifty-three plus fifty-
seven and six tenths; thence north thirty degrees thirty-eight minutes
west, forty-two and four-tenths feet to station fifty-four plus naught
naught BC.
The land to be conveyed hereunder being a strip or parcel of vary-
ing width lying on the northwest (left) side of the hereinabove
described centerline, and being none and no one-hundredths feet wide
at a point thirty-three feet opposite station fifty-seven plus naught
naught; thence widening to seventeen feet at a point thirty-three feet
opposite station fifty-seven plus forty-three, and continuing seventeen
feet wide to a point thirty-three feet opposite station fifty-eight plus
seventy and eight-tenths equals station fifty-three plus fifty-seven and
six-tenths; thence widening to twenty-five feet at a point twenty-five
feet opposite station fifty-four plus naught naught BC.
Said strip or parcel contains seven one-hundredths acre, more or
less, and 1s shown outlined in red on blueprint entitled “Plat showing
land lying in Albemarle County, Virginia, to be conveyed to W. E.
Duke, et al., by the Commonwealth of Virginia, Department of High-
ways, scale one inch equals one hundred feet, dated December ninth,
nineteen hundred and thirty-six,” and now on file in the office of the
Department of Highways at Richmond, Virginia.
3. An emergency existing this act shall be in force from its
passage.
