Chap. 185.—An ACT to amend and-re-enact sections 1720 and 1721 of the Code
of Virginia, both of which sections are in chapter 72 of the said Code, on
regulating the practice of embalming, and the transportation and disposition
of dead bodies. [S B 27]

1. Be it enacted by the general assembly of Virginia, That sec-
tion seventeen hundred and twenty and seventeen hundred and twen-
ty-one of the Code of Virginia be amended and re-enacted so as to
read as follows:
Section 1720. Licenses, etcetera.—Every resident of this State
hereafter desiring to engage in the practice of embalming dead human
bodies within the State of Virginia, who is at least twenty-one years
old, and has completed a’ seventh-grade public school education or its
equivalent, and who has had at least a two years’ apprenticeship
under a licensed embalmer, shall make a written application to the
State board of embalming for a license, on forms furnished by the
board, which application shall be sworn to before a notary public,
and accompany same with a license fee of twenty-five dollars, where-
upon the applicant as aforesaid shall present himself or herself before
said board at a time and place to be fixed by said board; and if the
board shall find upon due examination that the applicant is of good moral
character, possessed of skill and knowledge of said science of em-
balming, and the care and disposition of the dead, and has a reason-
able knowledge of sanitation and the disinfection of bodies of de-
ceased persons, and of the apartment, clothing, and bedding in case
of death from infectious or contagious diseases, the board shall issue
to said applicant a license to practice said science of embalming, and
the care and disposition of the dead, and shall register such applicant
as a duly licensed embalmer. Such license shall be signed by a ma-
jority of the board and attested by its seal. All persons receiving
a license under the provisions of this section shall also register the
fact at the office of the board of health of the city or county, and where
there is no board of health, with the clerk of the circuit court in the
jurisdiction of which it is proposed to carry on said practice, and shall
display said license in a conspicuous place in the office of such licensee.
Only residents of this State shall be licensed upon examination; pro-
vided, however, the board may also license residents of adjoining
States and of the District of Columbia upon examination.
Section 1721. Renewal of embalmer’s license; appeals, licenses
issued by other States.—Every licensed embalmer, as provided in this
chapter, who desires to continue the practice of embalming in this
State shall, annually, on such date as the said board may fix, pay to
the secretary of the board the sum of five dollars for the renewal of
license; and if the applicant for the renewal of such license has com-
mitted no offense against the laws of this State since the issue of the
previous license, or has not violated the rules of said board of em-
balming, or been guilty of unprofessional or dishonorable practice,
the secretary shall issue a renewal license to the applicant; but if th
laws of this State, or the rules of the board of embalming, have been
violated by such applicant, or has been guilty of unprofessional or
dishonorable practice, then the application for renewal shall be re-
ferred to the board for its action, which board may grant or refuse
such renewal, as the facts may warrant, subject to the right of appeal
to the corporation court of the city, or circuit court of the county in
which the applicant resides, either in term or vacation. Authority
is given said board of embalming to suspend during any year a license
previously issued by said board, for gross incompetency, neglect of
duty, unprofessional or unetical practice, dishonesty, or any act
derogatory to the standing of the profession; but in case of any such
suspension, the party affected thereby shall have the right of appeal
to the corporation court of the city, or circuit court of the county, as
the case may be, in which he resides, either in term or vacation. The
State board of embalming is empowered to recognize, in this State,
licenses issued in other States to practice embalming, under such re-
quirements and regulations as may be prescribed by said board.
The members of this board shall not be paid more than eight dollars
per diem and*traveling expenses for carrying out the provisions of
this chapter. The board shall administer its affairs in an economical
and business-like manner and shall on the first day of each August
submit to the auditor of public accounts an itemized statement of
all receipts and expenditures of the board for the twelve months pre-
vious. All money in the hands of the board on the first day of each
August in excess of five hundred dollars shall be paid into the State
treasury.
