Chap. 164.—An ACT to amend and re-enact section 1416 of the Code of Virginia.
Approved March 14, 1904.
1. Be it enacted by the general assembly of Virginia, That section
fourteen hundred and sixteen of the Code of Virginia be amended and
re-enacted to read as follows:
§ 1416. Right of repeal, et cetera, bv general assembly, and to prohibit
burials in cemeteries adjoining Barton Heights.—The six preceding sec-
tions shall be subject to amendment or repeal, and the rights thereunder
acquired, to control, modification or revocation by the general assembly.
And the council of the town of Barton Heights, Henrico county, is em-
powered to prohibit by ordinance the burial of dead bodies in the ceme-
teries adjoining the said town, and known as Ham’s, Cedarwood, Metho-
dist, Union Mechanics’, Ebenezer, and Sycamore cemeteries, except in
euch land of said cemeteries where it can be shown by duly kept records
of said cemeteries that no burials have ever been made. And the said
council may provide in such ordinance penalties for the violation of same
by fine not exceeding fifty dollars, or imprisonment in jail not exceed-
ing twelve months.
