CHAPTER 82
An Act to authorize the Department of Welfare and Institutions, subject
to the approval of the Governor, to convey certain real estate in the
counties of Smyth and Scott, and to provide for the application of
the proceeds.

Be it enacted by the General Assembly of Virginia:
1, § 1. That the Department of Welfare and Institutions be, and it is
hereby subject to the approval of the Governor, authorized to convey to
suitable purchasers, the following described real estate: That certain
tract or parcel of land located in the Marion Magisterial District, Smyth
County, Virginia, and more particularly described as follows:
Being a tract of land 20 feet in width extending from the Lee Highway
(U.S. No. 11) along a private road of 20 feet in width to the Norfolk and
Western Railway right of way and being part of lots Nos. 77, 76 and 142
as shown on a plat of land purchased by G. D. Pettit from J. E. Thomas
of record in the Clerk’s Office of the Circuit Court of Smyth County in
plat book 4 page 69, and said road which it adjoins is the 20 ft. road shown
on said plat and said property being on the eastern side of the property
conveyed to G. D. Pettit and Mae J. Pettit as joint tenants retaining the
right of survivorship by deed dated April 17, 1948, and of record in the
Clerks giice of the Circuit Court of Smyth County in deed book 100
page .
All of that certain parcel or tract of land with improvements thereon
lying on the north of the Norfolk and Western right of way in Marion
pistrict, Smyth County, Virginia, and more particularly described as
ollows:
Beginning at a point on the north side of the Norfolk and Western
Railway right of way (western part of the property) thence north with
Preston line 1800 feet to a stake; thence S 55:27 E 1238 feet to a fallen
Spanish oak; thence S 42:09 E. 2640 feet to a white oak; thence S 3:45
E 553 feet to the Norfolk and Western Railway Company right of way;
thence with the northern line of said right of way in a westernly direction
3185 feet to the beginning and containing 98.5 acres, more or less and
being a part of the “Old Haller Farm” and reference is expressly made
to the plat of Walter L. Gollehon, surveyor, showing said land of record
in the Clerk’s Office of the Circuit Court of Smyth County in plat book 4
page 67 and there is included in this conveyance 2 separate rights of way
across the Norfolk and Western Railroad and out to Lee Highway (U. S.
Route 11) both of which rights of way are reserved for the use and
convenience of the property herein described and for the benefit of the
other owners of land adjacent to said right of way.
The following described tracts or parcels of land, lying and being on
the waters of North Fork of Clinch River in the Powell Magisterial Dis-
trict of Scott County, Virginia:
TRACT NO. (1)—Located on the north side of State Highway Rt.
No. 638, and beginning at a concrete highway right of way marker in the
north side of right of way of Rt. 638, and in the line fence with Virgil
Bledsoe, thence with meanders of line fence and with Virgil Bledsoe’s line
N. 23-36 W 64 feet, to a cedar snag post, N 29-11 W. 274.6 feet to a post,
N 25-51 W. 82.5 feet N. 30-11 W. 75.4 feet, N 29-06 W 159.5 feet; N. 23-29
W 39.4 feet, to a cedar; N 16-10 W. 51.5 feet, N. 37-37 W 104 feet to a
poplar snag, N 29-09 W 46.0 feet; N 24-53 W 50.6 feet to a sassafras
snag, N 28-22 W 101.7 feet N 27-32 W. 289.6 feet; N 31-82 W 59.8 feet
to a locust stump; N 27-0 W 80.0 feet to a large black walnut, corner to
Old Pattonsville School Property, now owned by Frank Fraley and others,
thence leaving the Virgil Bledsoe line fence and with bearings of old school
deed dated March, 1909, recorded in Deed Book 51, page 109, thence S
42-31 W 383.4 feet to iron stake (set this survey); thence N 26-47 W.
282.3 feet to iron stake (set this survey) ; in north R/W line of Rt. 638,
(Reference to iron stake S 85-10 W 50.48 feet to R/W marker, southside) ;
thence with north R/W of Rt. 638, (reference, located 25 and 30 feet
north of a traverse line on center of travel Rt. 638, beginning of traverse,
N 85-10 E 25 feet from highway marker south side); thence with
meanders of traveled road S 7-14 W 730 feet; S 5-02 E 194.6 feet; S 50-37
E 838.5 feet to the intersection of Rt. 638 and center line of Rt. 624, (this
point 25 feet north of R/W marker, south side) thence with Rt. 638
S 61-30 E 98.5 feet; thence S 81-02 E 129 feet, S 83-42 E 446 feet, N 88-32
E. 251 feet, thence N 7-02 W. 25 feet to R/W marker, the beginning, con-
taining 19.8 acres, more or less.
TRACT NO. (2)—Located on the south side of Route 638, and be-
ginning at a point in Route 638, traverse line, this point intersection of
Rt. 638 and Rt. 624, said point 25 feet north of R/W marker, thence with
center of Rt. 624 to intersection of 12 foot easement S 86-47 W 103 feet;
thence S 9-03 W 269 feet with center of easement to fence Elm pointer
3 feet N E and a corner with Ezra Hood, thence with fence S 41-23 W,
273 feet, S 41-56 W 136 feet to large cedar in fence; thence S 20-30 W
62.5 feet; thence with fence S 43-43 W 378; S 47-10 W 106 feet to a post
at foot bridge (this bridge said to be a community bridge) thence S 26-56
W 135 feet with down stream side of bridge and crossing North Fork
River to a point at end of bridge at Mrs. E. T. Lane property; thence S
12-11 E 997 feet to iron wood, top of Bluff, to iron wood and Black Oak
pointer East, corner with a J. W. Rhoton; thence with Rhoton’s line on
top of Bluff as it meanders N 87-07 E 132 feet to Hickory; N 60-16 E
250 feet, N 76-16 E 191 feet; north 86-04 E. 321.6 feet Oak Sapling; N
78-52 E 426 feet to Maple N 67-11 E 75.7 feet, S 80-40 E 183.7 feet to a
large white Oak, a corner with Rhoton and Virgil Bledsoe; thence with
Bledsoe line and leaving top of Bluff N 24-40 W 1822 feet, crossing North
Fork River to a corner post east of Farm road; thence with meanders of
fence N 18-14 E 21 feet to a double Cedar, thence N 63-0 E 48 feet, East
side gate. farm road and in Old Turnpike right of way; thence with fence
N 69-0 W 75 feet to a post, in old Turnpike right of way, thence N 24-45
E 12 feet; this point south R/W of 638 and 30 feet from traverse line,
Rt. 638, thence N 57-15 W 93 feet to right of way marker; thence N
82-45 E 25 feet, the beginning, containing 45.8 acres, more or less.
TRACT NO. (8): This parcel lies south of R/W line of Rt. 688 and
lines of Old Turnpike. Beginning at Iron stake on south side of Rt. 638
and south R/W of old Turnpike, (this stake S 67-35 W 39.4 feet from
N.W. corner of Cold School property and is the North line of small tract
conveyed by J. C. Clark to Scott School Board, August 18, 1922); this
tract south of line and west of 1909 deed; thence from Church corner S
15-27 W 211.3 feet to iron stake, corner of church, (this line crossing Old
Turnpike.) property and in fence line with Mrs. Burchett; thence with
her line S 32-34 E 31 feet, thence leaving fence to R/W of 6388 S 84-0 E
80 feet; thence N 3-25 E 256 feet to R/W marker, south side of 638;
thence N 14-0 W 32 feet to the beginning, containing 0.12 acres, more
or less.
Said Three tracts or parcels of land were surveyed by E. V. St. Martin,
Engineer, Gate City, Virginia, April, 1960, and being the same tracts or
parcels of land that were owned by J. C. Clark and Minerva Gobble Clark
and devised to I. N. Gobble and Robert E. Gobble; said will having been
probated in the Clerk’s office of Scott County, Virginia, on July 24, 19389,
and recorded in Scott County Clerk’s office in Will Book No. 23 at page
209; the interest of I. N. Gobble was devised to Robert E. Gobble by will
probated in the Clerk’s office of Scott County, Virginia, on February 11,
1940, and of record in the Clerk’s office of Scott County in Will Book No.
25 at page 319.

The proceeds from such sale are hereby appropriated for the pur-
poses stated in Item 777, Chapter 719, Acts of Assembly of nineteen
hundred sixty-six, which is the Appropriation Act.
