CHAPTER 640

An Act to amend the Code of Virginia by adding a section numbered
46.1-413.1 to require the appearance of prosecuting attorneys in
certain cases involving motor vehicle law violations.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia be amended by adding a section num-
bered 46.1-413.1, as follows:

§ 46.1-413.1. If requested by the judge trying the case, it shall be
the duty of all attorneys for the Commonwealth and all city and town
attorneys whose general duties include the prosecution of offenses which
are reportable by the courts to the Division of Motor Vehicles under
§ 46.1-413, to appear on behalf of the Commonwealth or such locality in
any contested criminal case wherein a resulting conviction is required to
be reported to the Division under § 46.1-413.

The failure of such attorney to appear shall, in no case, affect the
validity of any conviction.
