Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a new section num-
bered 18.1-88.1 as follows:
§ 18.1-88.1. If any person break and enter a dwelling house while
said dwelling is occupied, either in the day or night time, with the intent
to commit assault or any other misdemeanor except trespass, he shall be
guilty of a felony, and upon conviction thereof, he shall be punished
by confinement in the penitentiary for a term of not less than one nor more
than ten years, or by confinement in jail for not more than twelve months
or by a fine of not more than $1,000.00, either or both in the discretion of
the court or jury trying the same.
