An Act to amend and reenact §§ 9-100, 9-102, 9-108, and 9-104.1 of the
Code of Virginia, and to further amend the Code of Virginia, by add-
ing sections numbered 9-101.1 and 9-104.2; all of which relate to the
Commission on the Aging.

Be it enacted by the General Assembly of Virginia:
1. That §§ 9-100, 9-102, 9-103 and 9-104.1 of the Code of Virginia be
amended and reenacted, and that the Code of Virginia be amended further
by adding sections numbered 9-101.1 and 9-104.2, as follows:
§ 9-100. Creation of Commission; ex officio and appointive mem-
bers.—There is hereby created in the Executive Department, a Commis-
sion on the Aging, hereinafter referred to as the Commission. The Com-
mission shall consist of the State Health Commissioner, the Superintendent
of Public Instruction, the Director of the Department of Welfare and
Institutions, the Commissioner of Labor and Industry, the Commissioner
of Mental Hygiene and Hospitals, the Commissioner of the * Virginia
Employment Commission, hereinafter designated ex officio members, a
chairman, and five other persons, hereinafter designated appointive mem-
bers, appointed by the Governor from the general public.
§ 9-101.1. The Commission shall elect a vice-chairman who shall
have full authority to act for the chairman in his absence. The Com-
mission may elect a secretary and such other officers as it may deem desir-
able and prescribe their powers and duties. The Commission is authorized
to adopt rules and regulations for the management of its affairs and for
carrying out the duties imposed upon it by this chapter, and may ap-
point an executive committee to act for the Commission on matters arising
during the periods between its meetings.
§ 9-102. The State Health Commissioner, the Superintendent of
Public Instruction, the Director of the Department of Welfare and Institu-
tions, the Commissioner of Labor and Industry, the Commissioner of the *
Virginia Employment Commission and the Commissioner of Mental Hy-
giene and Hospitals, shall serve without additional compensation. Their
traveling and other necessary expenses as members of the Commission
shall be paid from available funds appropriated to their respective depart-
ments or agencies. When any ex officio member is unable to attend any
meeting of the Commission, he may designate an employee of the depart-
ment or agency of which he is head to act in his place and stead *.
When an ex officio member designates a representative to attend a meéet-
ing of the Commission in his place and stead, such representative may have
voting privileges and may be counted in determining the presence of a
quorum subject to rules and regulations adopted by the Commission pur-
suant to § 9-101.1.
§ 9-103. The chairman of the Commission shall be paid * such salary
as may be determined by the General Assembly. The five appointive mem-
bers shall receive as compensation for their services the sum of ten dollars
for each day spent, and shall be reimbursed for their necessary traveling
and other expenses incurred, in the performance of their duties.
§ 9-104.1. (a) The Commission is hereby designated as the single
State agency, under Public Law 89-73 or any law amendatory or supple-
mental thereto of the Congress of the United States, and as the sole
agency for administering or supervising the administration of * such
plans as may be adopted in accordance with the provisions of such law
or laws. As such agency, the Commission shall have the authority to
prepare, submit and carry out * State * plans and shall be the agency
primarily responsible for coordinating State programs and activities re-
lated to the purposes of, or undertaken under, such * plans or * laws.
(b) The Commission, with the approval of the Governor, may
apply for and expend such grants, gifts or bequests from any source
as may become available in connection with its duties under this * Chapter.
The Commission is authorized to comply with such conditions and require-
ments as may be imposed in connection therewith.
(c) The Commission shall hold such hearings and conduct such in-
vestigations as are necessary to pass upon applications for approval of a
project under such * plans or * laws. The Commission shall make such
reports to the Secretary of the United States Department of Health,
Education and Welfare as may be required.
(d) All agencies of the State shall assist the Commission in effec-
tuating its functions in accordance with its designations as the single
State agency under the terms of such law or laws.
§ 9-104.2. The governing body of every county and city, or any
combination thereof, may establish a local or district commission on the
aging in accordance with rules and regulations promulgated by the Com-
mission. Such local or district commission shall assist the State Commis-
sion in the performance of the duties imposed upon it by this Chapter.
