CHAPTER 398

An Act to amend the Code of Virginia by adding a section numbered
18.1-81:1, relating to the possession of explosive devices or substances.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
18.1-81 :1, as follows:
§ 18.1-81:1. The possession of explosive devices or substances, as de-
fined by § 40-20.1, in the vicinity of any structure, building, bridge, lock
or dam within the scope of §§ 18.1-78, 18.1-80 or 18.1-81, by any person
who has not been issued a permit for the handling or use of same pursuant
to § 40-20.3, shall be prima facie evidence of an intent to commit an offense
specified in §§ 18.1-78, 18.1-80 or 18.1-81 in any prosecution thereunder
or for an attempt to violate one of such sections; provided, however, that
this section shall not apply to the possession of such devices or substances
by a public service company or any agent or employee thereof in the
course of his employment with such company.
