CHAPTER 305
An Act to amend the Code of Virginia, by adding a section numbered
19.1-46.1, to authorize the use of certain parts of the body following
post-mortem examinations for certain purposes.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
19.1-46.1, as follows:
§ 19.1-46.1. In any case where a patient is in immediate need for an
internal organ as a transplant, the chief medical examiner or his deputies
where a decedent comes under their jurisdiction; who may provide a
suitable organ for transplant and there is insufficient time to contact the
next of kin of the decedent in order to maintain the viability of the organ
to be transplanted, and no known objection by the next of kin is foreseen
by the chief medical examiner or his deputies; the chief medical examiner
or his deputies may in their discretion where providing the organ for
transplant will not interfere with subsequent course of the investigation
or autopsy provide such organ on the request of the transplanting surgeon.
