CHAPTER 299

An Act to permit the governing bodies of certain counties to reimburse or
pay for damage to property owners as a result of sewer backup.
Be it enacted by the General Assembly of Virginia:

1. § 1. The governing body of any county having a population of more
than two hundred thousand inhabitants may appropriate funds for the
purpose of reimbursing for or paying for damages to property owners in
such counties caused by the backup of sanitary sewers owned and main-
tained by the county within such county. Claim for damages shall be
made as may be provided by the governing bodies of such counties by
ordinance. No claim shall be allowed unless the damage is found to be
a result of negligent maintenance or operation, faulty construction or over:
loading of a sewer line. In no event shall the county be liable in excess
of the amount appropriated in each case.
