CHAPTER 238

An Act to amend the Code of Virginia, by adding a new section num-
bered 38.1-295.1 empowering the Commission to examine and n-
vestigate into the affairs of insurance companies and agents thereof
and to provide penalties for such companies or agents who fail or
refuse to permit such examination or investigation. CH 726]

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia be amended by adding a section numbered
38.1-295.1, as follows:

§ 38. 1-295.1. The Commission shall have power to examine and in-
vestigate into the affairs of every person engaged in the business of
insurance in this State including all licensed agents of insurance com-
panies in order to determine whether any such person has engaged, or
is engaging, in any violation of the provisions of Title 38.1 of the Code
of Virginia and shall have the right to examine any paper, document
or other material relating to the writing of insurance by any licensed
agent in this State in order to determine whether any such licensed
agent is now, or has been, engaged in the violation of any of the pro-
visions of law relating to the writing of insurance by agents licensed
by the Commission to write insurance in this State. Any licensed agent,
or any person purporting to be a licensed agent, who refuses to permit
the Commission or any of its employees or agents, including employees
of the Bureau of Insurance, to make such examination or who fails or
refuses to comply with the provisions of this section may, after notice
and an opportunity to be heard, subject himself to any of the penalties
relating to agents licensed by the Commission provided in Title 38.1
of the Code of Virginia, including the suspension or revocation of his
license to act as an insurance agent as provided in § 38.1-311 of the
Code as amended from time to time.
