An Act to authorize and empower the Commission of Fisheries to grant
to Virginia Electric and Power Company a certain easement of
right of way across the James River between Isle of Wight County
and the city of Newport News.

Whereas. by Chapter 199 of the 1954 Acts of Assemb'y, the Com-
mission of Fisheries was authorized to convey to Virginia Electric and
Power Company a permanent easement of right of way for an electric
transmission line across the James River; and
Whereas, pursuant to said authority, the Commission conveyed such
an easement, and electric transmission line facilities were constructed
thereon; and
Whereas, by reason of the enormous growth of consumption of elec-
tricity in eastern Virginia it is now necessary to substitute transmission
facilities of greater capacity for those constructed on the aforesaid ease-
ment: and
Whereas, it is necessary for continuity of electric service that the
new facilities be constructed and connected prior to the removal of the
existing facilities, and this necessitates the granting of a new easement
approximately paralleling the easement previously conveyed; now, there-
ore,
Be it enacted by the General Assembly of Virginia:
1. § 1. The Commission of Fisheries is hereby authorized and empow-
ered to grant and convey unto Virginia Electric and Power Company, its
successors and assigns, upon such terms and conditions as the Commis-
sion shall deem proper, a permanent easement of right of way one hun-
dred twenty feet in width to construct, operate and maintain a double
circuit electric transmission line, including metal towers, conductors and
appurtenances, across the James River, the center line of such easement
beginning at a point in the southerly bank of the James River, which
point is located in Isle of Wight County, Virginia, and is N. 43° ‘15’ 00”
E. 273.13 feet from an iron pin (said iron pin being S. 12° 52’ 54” E.
19,983.78 feet from the White Shoals Lighthouse) ; thence N. 438° 15’ 00”
10,004.50 feet to a point; thence N. 44° 00’ 27” E. 138,830.37 feet to a
point in the northerly bank of the James River, which point is located
in the city of Newport News, Virginia, and is S. 44° 00’ 27” W. 79.42
feet from an iron pin. The instrument so granting and conveying the
easement of right of way shall be signed and executed in manner and
form approved by the attorney for the Commission.
§ The authority granted by § 1 of this act shall be exercised
only upon the approval of the Governor first obtained in writing.
