CHAPTER 175

An Act to amend the Code of Virginia by adding in Title 56 a new section
numbered 56-405.1 relating to agreements for the maintenance and
repair of railroad grade crossings.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia be amended by adding in Title 56 a new
section numbered 56-405.1 as follows:

§ 56-405.1. Whenever the State Highway Commissioner determines
that it is in the best interest of the public, he is authorized to enter into
an agreement with any railroad company for the repair or maintenance
of any crossing of a railroad and a public road or for the sale of materials
to the railroad company for the repair and maintenance of any such cross-
ing. Any such agreement shall provide for the railroad company to hear
the cost of the repair or maintenance or material furnished and such other
conditions as the Highway Commissioner deems necessary or advisable to
protect the interest of the public.
