CHAPTER 139
An Act to amend the Code of Virginia by adding a section numbered
22-57.2, relating to authority of school boards regarding timing and
methods of paying compensation to certain teachers and other per-
sonnel.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
22-57.2, as follows:
§ 22-57.2. School boards may adopt rules and regulations govern-
ing the timing and methods of payment of compensation of teachers and
other personnel under term or annual contracts as follows:
(a) Payment of contract salaries may be made in equal monthly
installments not exceeding twelve, irrespective of the actual contract work
period; provided, however, that no payment shall be made which will
exceed the net unpaid earnings of the employee to the date of each pay-
ment.
(b) In lieu of making the salary warrant payable to the employee,
the school board may, upon written authorization of the employee, make
the warrants payable to, and deposit them in a designated bank or other
depository (hereinafter referred to as bank) for credit to the account
of the employee. It may also provide for depositing salary warrants
payable to the employee for credit to the account of the employee in a
designated bank.
(c) To facilitate the disbursing procedure, the school board may
provide for warrants to be issued to each designated bank for each pay-
roll period for the total of the net salaries of all employees, who have
authorized deposits to be made to their credit in the designated bank.
(d) When either of the foregoing procedures are followed, the
school board shall furnish to each bank in duplicate a listing of the
employees and the net payment to be credited to each employee’s account,
and the bank shall sign and deliver to the school board one copy of the
listing acknowledging receipt of the amount so deposited and _ shall
furnish a deposit slip to each employee showing the credit made to his
account. In lieu of signing the aforementioned schedule, the school board
may provide for the bank to furnish them in its stead duplicate copies
of the deposit slips. The signed schedule or duplicate deposit slips shall
be retained by the school board in support of the contract payments and
for audit purposes.
Salary payments heretofore made by school boards which have been
authorized under substantially the same procedure as are herein provided
are hereby validated and approved.
2. An emergency exists and this act is in force from its passage.
