CHAPTER 610
An Act to amend and reenact § 54-88.2 of the Code of Virginia, relating
to the definition of certain terms pertaining to barbering.

Be it enacted by the General Assembly of Virginia:
1. That § 54-88.2 of the Code of Virginia be amended and reenacted
as follows:
§ 54-88.2. The following words and phrases, when used in this
chapter, shall, for the purpose of this chapter, have the meanings respec-
tively ascribed to them in this section, except in those instances where
the context clearly indicates a different meaning.
(a) “Barbering’—Any one or any combination of the following
acts, when done on the human body for pay or reward and not for the
treatment of disease, to wit, shaving, shaping and trimming the beard;
cutting, singeing, shampooing or dyeing the hair or applying lotions
thereto; applications, treatment or massages of the face, neck or scalp
with oils, creams, lotions, cosmetics, antiseptics, powders, clays, or other
preparations in connection with shaving, cutting or trimming the hair or
a beard. Provided, however, the term “barbering” shall not apply to such
acts as described hereinabove when performed by any person in his home
tf such service is not offered to the public.
_(b) “Barber Shop”—Any establishment or place of business within
which the practice of barbering is engaged in or carried on by one or
more * barbers. Provided, however, any person engaged in the practice of
barbering on or before July 1, 1966, in any establishment or place of bust-
ness within which the practice of barbering was carried on by only one
barber, shall be issued a certificate as a registered barber without examina-
ton, provided such person files an application with the Board on or before
January 1, 1967. Provided, further, one-barber shops shall be excepted
from this chapter in towns of 500 population or less and rural areas in
counties with a population of 100 persons per square mile or less.
(c) “Board”—The Board of Barber Examiners.
