CHAPTER 55
An Act to repeal §§ 2-88.1, 2-88.2, 2-88.8, 10-128, 10-125.1 and 10-126 as
amended of the Code of Virginia; to amend and reenact §§ 2-84,
2-46, 2-47, 2-57.01, 2-65, 2-66, 2-66.2, 2-77, 2-77.1, 2-77.2, 2-77.7, 2-
77.8, 2-81 and 55-297, as severally amended, of the Code of Virginia,
and to amend the Code of Virginia by adding §§ 2-45.1 through 2-45.5,
2-57.02 through 2-57.04 and 2-65.1, all relating to organization of the
government generally; to create for and in the office of the Gov-
ernor the position of Commissioner of Administration to supervise
the Division of the Budget and the Division of Personnel, a new
Division of Engineering and Buildings and a new Division of Plan-
ning, and to perform certain other duties; and to provide, generally,
for the functions, management and funding of such office and divi-
sions.

Be it enacted by the General Assembly of Virginia:
- §§ 2-38.1, 2-88.2, 2-38.83, 10-123, 10-125.1 and 10-126 as amended
of the Code of Virginia are repealed.
2. That §§ 2-34, 2-46, 2-47, 2-57.01, 2-65, 2-66, 2-66.2, 2-77, 2-77.1,
2-77.2, 2-77.71, 2-77.8, 2-81 and 55-297, as severally amended, of the Code
of Virginia be amended and reenacted and that the Code of Virginia
be amended by adding §§ 2-45.1 through 2-45.5, 2-57.02 through 2-57.04
and 2-65.1 as follows:
§ 2-34. In the Governor’s office there shall be the following divisions:
Division of the Budget, Division of Records *, Division of Industrial
Development *, Division of Personnel, Division of Planning, Division of
Engineering and Buildings, and an office of Economic Opportunity. —
§ 2-45.1. There is hereby created in the office of the Governor the
position of Commissioner of Administration. The Commissioner shall be
appointed by the Governor, subject to confirmation by the General As-
sembly tf tn session when the appointment is made, and if not in session
then at its next succeeding session. He shall hold office at the pleasure of
the Governor for a term coincident with that of the Governor making
the appotntment or until his successor shall be appointed and qualified.
Before entering upon the discharge of his duties the Commissioner shall
take an oath that he will faithfully execute the duties of his office.
§ 2-45.2. The Commissioner of Administration shall supervise the
Dirision of the Budget, the Division of Personnel, the Division of Plan-
ning and the Division of Engineering and Buildings and shall coordinate
their activities with those of other divisions and agencies; all reports to
the Governor from the directors of these divisions shall be made through
the Commissioner. In addition, the Commissioner shall exercise such
powers and perform such duties as may be delegated to him by the
Gorernor to execute the management functions of the Governor. All
State agencies shall make available to the Commissioner any information,
when requested by him, which they are required by law to provide to the
Governor. The Commissioner shall be responsible only to the Governor.
$ 2-45.3. The Commissioner of Administration shall be paid such
com pensation as the Governor may fiz.
§ 2-45.4. The Governor is authorized to empower the Commissioner
of Administration to employ such personnel and to contract for such
consulting services as he may require to carry out the purposes of Chapters
5 through 9 of this title. Except as may be directed by the Governor,
personnel employed by the Commissioner shall be subject to the provisions
of Chapter 9 of Title 2 of the Code of Virginia.
$s 2-455.5. The expenses of the office of the Commissioner of Ad-
ministration shall be paid from funds provided for the purpose by law;
provided, however, that in addition thereto the Governor may supplement
such funds from appropriations made to his office for the executive control
of the State or for discretionary purposes.
s 2-46. The Governor shall be the chief budget officer of the State.
The Governor shall appoint a Director of the * Budget, who shall hold
his position at the pleasure of the Governor. *
s 2-17. The Director of the Budget shall, under the direction and
contro! of the Governor, acting through the Commissioner of Administra-
‘fiom, exercise such powers and perform such. duties as are conferred or
imposed by law upon him; and he shall perform such other duties as may
ie rejuired of him by the Governor and the Commissioner of Administra-
ion.
In addition thereto, such Director shall requisition the number of
and designate the quality and manner of binding of every annual or
hiennial report, including catalogs of State supported institutions of
higher learning, proposed by any State department, division, institution,
eficer or agency, to be printed out of public funds; and it shall be un-
lawful for any such report or catalog to be printed unless and until it
shall have been submitted to such Director and a certificate thereof,
siened by such Director, shall have been attached to the report or other
catalog.
The Director of * the Budget shall not, however, edit or change in
any respect any such report or catalog.
§ 2-57.01. The Division of Industrial Development and Planning,
heretofore established and hereinafter referred to as Division, is re-
designated the Division of Industrial Development and shall be under the
supervision and direction of the Governor. The Governor shall appoint
* a Director of the Division who shall hold his position at the pleasure
of the Governor, and who shall be paid such compensation as the Gov-
ernor may fix. The Governor shall also appoint an Advisory Board con-
sisting of eleven members. The * Director shall be an ex officio member
of the Board. The members of the Advisory Board shall be appointed
initially as follows: Three members for terms of two years, four members
for terms of three years and four members for terms of four years,
and thereafter all members shall be appointed for terms of four years.
The appointments to membership on the Advisory Board shall be subject
to confirmation by the General Assembly, if in session, and, if not, then
at the succeeding session. Vacancies on the Advisory Board shall be filled
for the unexpired term, subject to confirmation as original appointees.
The members of the Advisory Board shall receive no salaries but
shall be paid their necessary travelling and other expenses incurred in
attendance upon meeting, or while otherwise engaged in the discharge of
their duties.
The Division, under the supervision and direction of the Governor,
is charged with the responsibilities for carrying out * the State’s program
in the field of industrial development including specifically the duty to
(a) see that there is prepared and carried out an effective industrial
advertising and promotional program and respond to inquiries resulting
from the advertising program for new industries and received from other
sources; (b) make available, in conjunction and co-operation with local-
ities, chambers of commerce, and other private or public groups to pro-
spective new industries basic information regarding industrial sites, nat-
ural resources and labor supply, and other pertinent factors of interest
and concern to such industries; (c) * formulate, promulgate and ad-
vance programs throughout the State for the purpose of encouraging the
location of new industries in the State and the expansion of existing
industries; in general, to encourage, stimulate and support the industrial
development and the expansion of the economy of the Commonwealth.
_ The Division of Industrial Development and the Division of Plan-
ning each is authorized to apply for and accept and utilize grants and
other assistance from any governmental agency or department, and from
any public or private foundation, fund or trust, to contract with such
governmental agency or department and any other public or private
sources, to receive advances or progress payments, * to contract with
* public agencies and political subdivisions, and to exercise all other
powers necessary to carry out the purposes of this * chapter.
The Governor shall have control of the expenditure of any funds
appropriated for the industrial advertising and promotional program ad-
ministered under the provisions of this section.
§ 2-57.02. The Governor shall appoint a Director of Planning, who
shall be a fully qualified, experienced planner, and who shall hold his
position at the pleasure of the Governor.
§ 2-57.08. The Director of Planning shall, under the direction and
control of the Governor, acting through the Commissioner of Administra-
tion, exercise such powers and perform such duties as are conferred or
wmposed by law upon him; and he shall perform such other duties as
may be required of him by the Governor and the Commissioner of Ad-
ministration.
In addition thereto, the Director of Planning shall have the following
enumerated responsibilities:
(a) Basic State-wide Planning, to include:
(1) Encouraging, assisting and coordinating the planning efforts
of State agencies, political subdivisions and geographical regions.
_ (2) Developing a master plan for the State, incorporating projec-
tions and developments pertaining to population, transportation, com-
merce, agriculture, resources and land use; the master plan to represent
the coordinated efforts and results of all participating planning groups.
(3) Making long and short-range economic analyses and projec-
tions to anticipate future possibilities in developing various areas of the
economy; such analyses and projections to assist in determining future
sources of revenue and evaluating the efforts of current and proposed tax
policies.
(4) Maintaining liaison with the appropriate agencies of the fed-
eral government for the purpose of keeping the Governor and State
agencies informed as to their plans, programs and policies.
(b) Internal Planning of State Agencies:
(1) Assisting agencies in expressing their internal long-range plans
in common terms so they may be translated into consistent goals and
objectives that may, in turn, serve as the basis for budgetary request
justifications.
(2) Reviewing, codifying, consolidating, publishing and distribut-
ing the long-range plans of State agencies.
(ec) Local, Regional and Special Planning Services:
(1) Furnishing professional assistance, upon request to any co-
operating jurisdiction or agency.
(2) Furnishing the Division of Industrial Development and other
State agencies with professional assistance in making special economic,
resource or other types of studies, including the preparation of reports
on such studies.
(d) Cooperative and J oint Efforts in Planning:
(1) Participating in or arranging for the participation of others
mn interstate, regional or federal planning activities, as required.
(2) Cooperating with and utilizing the services of academic or
private, nonprofit organizations active in the same or related fields of plan-
ning as the Division.
(e) Activities Related to Planning:
(1) Constantly reviewing and analyzing the organizations and pro-
grams of the State’s interagency operations in order to recommend
gsimplincation whenever practical.
s 2-57.04. The Director of Planning, with the approval of the Gov-
ernor, is authorized to fix and collect charges for planning services ren-
dered counties, cities and towns by the Division of Planning. All such funds
so collected shall be paid into the general fund of the State treasury,
oro: ided, however, that any such charges made for maps, photographs,
plats or other prints or copies shall be based upon the actual cost of
materials only used in producing the same, and the funds received there-
from shall be deposited in the State treasury to the credit of the Division
and may be expended for the replacement of such materials so used.
£ 2-65. * The Governor shall appoint a Director of Engineering and
Buildings, who shall hold his position at the pleasure of the Governor.
The Director shall be an experienced graduate architect or engineer with
management experience.
S$ 2-65.1. The Director of Engineering and Buildings shall, under
the direction and control of the Governor, acting through the Convmis-
sioner of Administration, exercise such powers and duties as are con-
rerred and imposed by law upon him and as are heretofore vested in and
performed by the Director of the Budget pursuant to Article 1, Chapter 8,
of Title 2, of the Code of Virginia; and he shall perform such other
duties as may be required of him by the Governor and the Commissioner
of Administration.
The Director of Engineering and Buildings, hereinafter referred to as
Inrector, shall have under his care the public buildings, grounds and all
other property at the seat of government not placed in the charge of
others, and shall protect such properties from depredations and injury.
The Director shall be responsible for the development, in cooperation
with State institutions and agencies concerned, of maintenance and util-
ization standards for State buildings, and for the provision of functional
direction and service to institutions and agencies of the State govern-
ment with respect to their policies, practices and administration of butld-
ings and grounds.
§ 2-66. * The Director may employ such assistants and other per-
sonnel as may be required to perform his duties hereunder. _
§ 2-66.2. The Director of * Engineering and Buildings, with the
written approval of the Governor first obtained, may lease property
owned by the Commonwealth which has been or is hereafter acquired
for the development of the State site plan for permanent State office
buildings and related structures and facilities lying near the Capitol
Square. All such leases shall be prepared by the Attorney General; they
may run for such time as the Governor may prescribe and shall be for
such rental as appears proner. All rentals received therefrom shall be
paid into the general fund of the State treasury.
§ 2-77. The police * court of the city of Richmond shall have jur-
isdiction to try cases of misdemeanor arising under the preceding section,
and all other offenses committed in the Capitol Square of which * ¢té
would have jurisdiction if commit‘'ed within the corporate limits and
jurisdiction of the city; and the Capitol police, or any member thereof,
shall have the same authority to arrest and to swear out warrants for
offenses committed on the Capitol Square as policemen of the city of
Richmond have to arrest or to swear out warrants for offenses committed
within the jurisdiction of the city.
§ 2-77.1. * The Virginia Public Buildings Commission, hereinafter
in this article referred to as the Commission. is continued in existence as
heretofore constituted. The Commission shall consist of * eight members,
three of whom shall be appointed by the Speaker of the House of Dele-
gates from the membership of the House of Delegates, two of whom
shall be appointed by the President of the Senate from the membership
of the Senate; such members shall be appointed for a term to expire on
the date of the convening of the first regular session of the General
Assembly following their appointment: and the Governor shall appoint
two members of the Commission from the public at large. The terms of
Office of such members shall expire June thirty, nineteen hundred fifty-
two, and subsequent appointments shall be made for terms expiring every
four years thereafter. The * Commissioner of Administration shall be
* an ex officio member of the Commission.
§ 2-77.2. The Director of Engineering and Buildings. referred to
hereafter in this article as the Director, shall, subject to the written ap-
proval of the Governor: ;
(a) Have prepared and, when necessary to meet changing condi-
tions, amend a long-range site plan for the location of all State buildings,
and improvements related thereto, in or adjacent to the city of Richmond.
Acquire with such funds as may be appropriated for that pur-
pose the necessary land for effectuation of the plan.
(c) Direct and control the execution of all authorized projects for
the construction of State buildings and related improvements in or ad-
Jacent to the city of Richmond.
_ § 2-77.7.__ The Governor may transfer to the Division of * E'ngineer-
tng and Buildings funds appropriated to any State department, agency,
or institution for the construction, alteration, reconstruction and re-
pair of any building to be erected or acquired for the use of such depart-
ment, institution or agency, or for the acquisition of land therefor, or for
planning, architectural, engineering or other studies in connection there-
with, and may accept any funds donated for such purposes.
§ 2-77.8. The members of the Commission shall receive their ac-
tual expenses incurred in the performance of the duties imposed by this
article to be paid from the funds transferred to the Division of * En-
gineering and Buildings under § 2-77.7, or from any funds which may be
appropriated or made available to the Division for such purposes.
§ 2-81. The Governor shall be the Chief Personnel Officer of the
Commonwealth. He shall direct the execution of this chapter and he
* shall appoint a deputy personnel officer, who shall be known as Director
of Personnel, who shall exercise such powers and perform such duties
as may be delegated to him by the Governor, acting through the Commis-
stoner of Administration. He may employ such other competent personnel
assistants and employees as he may require to carry out its provisions.
If he so desires, * the Governor may appoint to serve at his pleasure an
advisory committee on personnel administration, composed of members
of the General Assembly and such other persons as he may designate.
At his discretion he may assign to officers and employees of the Common-
wealth such duties as he sees fit in connection with the administration of
this chapter; such officers and employees shall receive no extra compensa-
tion for such duties but shall be reimbursed for necessary travel and
other expenses.
§ 55-297. The * Division of Planning is herewith designated as the
authorized State agency to collect and distribute information, to author-
ize such modifications as are referred to in § 55-294, and generally to
advise with and assist appropriate State and federal agencies and in-
dividuals interested in the development of the provisions of this chapter.
