An Act to amend and reenact § $2-40.2 of the Code of Virginia, relating
to the creation of district health departments.

Be it enacted by the General Assembly of Virginia:
— That § 32-40.2 of the Code of Virginia be amended and reenacted as
ollows:
§ 32-40.2. (a) Any * city or county, or a combination thereof may,
by * resolution duly adopted by a majority vote of their respective govern-
ing bodies, create a district health department. The governing * body of
any such * district consisting of a single governmental unit may enter into
contractual agreement with the State Department of Health for the opera-
tion of the district health department thus created. In the event the district
consists of more than one governmental unit, the governing body of each
unit may, by separate action, adopt a resolution, authorizing the district
health department so created to enter into a contractual agreement with
the State Department of Health for the operation of such district health
department.
. (6b) Should any District Health Department so created lie wholly
within, or coincide with, the boundaries of a single political subdivision,
the governing body of such political subdivision is hereby authorized to
enter into a contract with the State Department of Health for the operation
thereof and notwithstanding any other provision of law any person who
becomes a State employee by virtue of such contract affiliating the local
governing body’s Department of Public Health with the State Department
of Health, shall remain a member of the local retirement system, provided
such person was an employee of such political subdivision and a member
of the local retirement system on the effective date of any such contract
and does not elect, in writing, and within sixty days after the effective
_ of such contract, to become a member of the State’s retirement
system.
2. Anemergency exists and this act is in force from its passage.
