CHAPTER 526
An Act to amend and reenact §§ 8-847, 3-848 and 8-851, as severally
amended, of the Code of Virginia, and to amend the Code of Virginia
by adding §§ 3-847.1 and $-847.2, the amended and new sections
relating to composition, terms and compensation of members of the
Muk Commission, and to prescribe what constitutes a quorum thereof.

Be it enacted by the General Assembly of Virginia:
1. That §§ 3-347, 3-348 and 8-351, as severally amended, of the Code
of Virginia be amended and reenacted, and that the Code of Virginia be
amended by adding §§ 3-347.1 and 3-847.2, as follows:
§ 3-347. There is hereby continued the Milk Commission, consist-
ing of * an administrator and four members, all of whom shall be ap-
pointed by the Governor, * two of whom shall be * producers of milk, *
and three shall be * consumers * but * none of such * three latter members
shall have any connection financially or otherwise with the production or
distribution of milk or products derived therefrom * . Any vacancies oc-
curring shall be filled by appointment by the Governor. One member of
the Commission shall act as chairman, as designated by the Governor. The
Governor shall annually appoint a new chairman from the membership of
the Commission. No member shall serve as chairman after he has so
served until each other member of the Commission has acted as chairman.
The administrator shall devote full time to the duties of his office, which
shall be located in the principal office of the Commission. The technical and
other services for such Commission shall be performed, so far as practicable,
by forces and officers in the Department of Agriculture and Immigration,
the Virginia Agricultural Extension Service of the Virginia Agricultural
Experiment Station, without additional compensation. The Commission
may appoint * a secretary and any such additional technical and other
assistants and employees as may be necessary to carry out the provisions
of this article, and prescribe their powers and duties.
——— « § -8-847.1. The administrator of the Commission shall hold office
at the pleasure of the Governor for a term concurrent with the term of
the Governor making the appointment or until a successor to that ad-
ministrator is appointed by the next succeeding Governor. Of the re-
maining four members of the Commission, two shall be consumers and
neither of such two members shall have any connection financially or
otherwise with production or distribution of milk or products derived
therefrom; the remaining two members shall be producers. Initially one
producer and one consumer shall be appointed to serve for a period of one
year and may, thereafter, be appointed for not more than two terms of
four years. The remaining producer and the remaining consumer shall
initially be appointed to serve for a period of three years and muy,
thereafter, be appointed for not more than two terms of four years. No
member except the administrator and those initially appointed may
serve for or during more than two terms of four years each; pro-
vided, however, any member appointed to fill an interim vacancy may be
appointed for not more than two additional terms of four years each
ae ie expiration of the term of the interim vacancy which that mem-
er filled.
§ 8-347.2. The Commission shall meet on the call of the chairman
or three of 1ts members at such times as he or they may deem necessary,
and at such place as he or they may designate.
§ 8-848. The administrator of the Commission shall receive such
compensation as the Governor may direct. The other members of the
Milk Commission shall be paid each the sum of * thirty dollars per day
for each day actually spent in the performance of their official duties,
plus their actual and necessary expenses.
The compensation of the * administrator, the secretary and other
employees of Milk Commission shall be such as may be provided in ac-
cordance with law for the purpose.
§ 3-351. * Three members of the Commission shall constitute a
quorum.
