An Act to amend the Code of Virginia by adding a section numbered
46.1-295.1, relating to the regrooving of certain motor vehicle tires;
the use and sale of such ttres; and providing a penalty for violations.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
46.1-295.1 as follows:
§ 46.1-295.1. (a) No person shall sell, offer or expose for sale, or
have in his possession with intent to sell any motor vehicle tire which has
been recut or regrooved; provided, however, that the sale of regrooved
or recut commercial vehicle tires which are designed and constructed in
such manner that regrooving or recutting is an acceptable and safe prac-
tice shall not be a violation of this section.
(b) No person shall operate a Virginia registered motor vehicle on
any highway in this State, with knowledge that such motor vehicle 18
equipped with any tire which has been regrooved or recut; provided, how-
ever, that the use of commercial motor vehicles and trailers or semi-
trailers which are equipped with regrooved or recut tires in accordance
with the provisions of (a) hereof shall not be a violation of this section.
(c) The provisions of (a) and (b) hereof shall not apply to regroov-
ing or recutting done in a tire recapping process.
(d) Any person violating the provisions of this section shall be guilty
of a misdemeanor and punished as provided by law.
