An Act to amend the Code of Virginia by adding a section numbered
62-58.1, to authorize the State Board of Health to seek injunctions
to prevent violations of tts orders regarding the public water supply;
to provide for additional charges in relation thereto. CH 716]

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
62-53.1, as follows:
§ 62-53.1. In addition to any other penalty or method available to
the Board to aid in the enforcement of its orders under the provisions of
this chapter, the Board may apply to an appropriate court for an in-
junction or other legal process to prevent or stop any practice, operation,
action or inaction constituting a violation of any order issued by the Board
under the provisions of this chapter and to enforce compliance with any
such order; provided, however, the owner of any waterworks, in existence
prior to the effective date of this act, shall have the right to make any
one or more of additional charges for connections or additional charges for
water to finance or defray the cost of such changes, alteration or exten-
sions caused as a result of any such order and the enforcement of any
such order and to defray any extra cost incident to the maintenance and
operation thereof, but nothing in this proviso shall be construed as pre-
venting an owner from including in future contracts provision for such
additional or supplemental charges.
