An Act to amend the Code of Virginia by adding in Chapter 15 of Title $
an article numbered 1.1, containing sections numbered 8-269.1 through
$-269.6, so as to authorize the Commissioner of Agriculture and Immi-
gration to require the registration of grain handlers; to require such
handlers to use the weighing procedures established by the Board;
to use the grading equipment approved by the Board; to require
such handlers to maintain records of transactions and to retain
samples of grain purchased; providing a penalty for violations.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Chapter 15 of
Title 3 an article numbered 1.1, containing sections numbered 3-269.1
through 3-269.6, as follows:
Article 1.1
§ 3-269.1. For the purposes of this article:
(a) “Board” means the Board of Agriculture and Immigration of
this State.
(b) “Commissioner” means the Commissioner of Agriculture and
Immigration of this State.
- (c) “Person” means an individual, partnership, corporation or asso-
ciation.
(d) “Handler” means a person who buys grain for resale as grain
or grain products.
(e) “Grain” means corn (maize), wheat, rye, oats, barley, flaxseed,
soybeans, and such other grains as the usages of the trade may warrant
and permit.
§ 8-269.2. The Commissioner is hereby authorized to require all
handlers to register with him on forms prepared for that purpose. Such
forms shall require the handler to state his name, address and the county
or city where he shall weigh and grade grain.
§ 38-269.3. The Board is hereby authorized to establish rules and
regulations relating to the handling of grain in this State, extending to
(1) The weighing devices, approved under the Virginia Weights and
Measures Law and the procedures employed to give accurate weights.
(2) The grading equipment that is acceptable in administering the
U. S. Grain Standards Act and the use of grading equipment to be used
in determining the value of grain. Such use of such equipment shall be
pursuant to procedures employed by inspectors li under the U. S.
Grain Standards Act.
(8) Samples of lots graded by other than a Virginia licensed inspec-
i and the lot discounted shall be identity preserved for twenty-four
ours.
(4) The keeping of records in accordance with good business practices.
§ 8-269.4. All persons before operating as a handler in this State
shall register with the Commissioner, if required to do so by him.
§ 3-269.5. No grain shall be bought for resale as grain or grain
products unless bought by a handler registered by the Commissioner.
§ 3-269.6. Any person who shall violate any of the provisions of
this article or the rules and regulations established by the Board shall
be guilty of a misdemeanor.
