An Act to amend and reenact § 8-94, as amended, of the Code of Vt
ginta, relating to suit by an assignee or beneficial owner in his ou

Be it enacted by the General Assembly of Virginia:

1. That § 8-94, as amended, of the Code of Virginia be amended and r
enacted as follows:

8-94. The assignee or beneficial owner of any bond, note, writir
or Other chose in action, not negotiable * may maintain thereon in h
own name any action which the original obligee, payee, or contractir
party might have brought, but, except as provided in § 8.9-206 shall allo
all just discounts, not only against himself, but against such oblige
payee, or contracting party, before the defendant had notice of the a
signment or transfer by such obligee, payee, or contracting party, ar
shall also allow all such discounts against any intermediate assignor |
transferor, the right to which was acquired on the faith of the assig:
ment or transfer to him and before the defendant had notice of the assigi
ment or transfer by such assignor or transferor to another.
