An Act to amend und reenact § 46.1-3869 of the Code of Virginia by
adding a provision relating to the waiver of examinations in certain
cases and under certain conditions for applicants for operator’s or
chauffeur’s licenses.

Be it enacted by the General Assembly of Virginia:
1. That § 46.1-369 of the Code of Virginia be amended and reenacted
as follows:
§ 46.1-369. (a) The Division of Motor Vehicles shall examine ev-
ery applicant for an operator’s or chauffeur’s license before issuing any
such license, except as otherwise provided in § 46.1-349. The Division
shall examine the applicant as to his physical and mental qualifications
and his ability to operate a motor vehicle in such manner as not to jeop-
ardize the safety of persons or property and as to whether any facts
exist which would bar the issuance of a license under §§ 46.1-357
through 46.1-362, but such examination shall not include investigation of
any facts other than those directly pertaining to the ability of the applicant
to operate a motor vehicle with safety, or other than those facts declared
to be prerequisite to the issuance of a license under this chapter and no
applicant otherwise competent shall be required to demonstrate ability to
park any motor vehicle except in an adequate parking space between
horizontal markers and not between flags or sticks simulating parking
vehicles
(b) In the event the applicant for an operator’s or chauffeur’s
holds an unexpired license or licenses to drive issued by one or more
other states, the examination herein provided for may be waived, provided
such applicant surrenders to the Division of Motor Vehicles such license
or licenses and at the time of application furnishes a transcript or copy
of his traffic violation and accident involvement record if any there be,
prepared by the licensing authorities of the state or states having issued
the aurreiiner en license or licenses, and that such record of operation would
not be sufficient to preclude issuance of such license, should the record
have been compiled in Virginia.
