An Act to amend and reenact § 18.1-411 of the Code of Virginia, relating
to interests of members of any board of visitors, directors, employees,
agents and certain other officials of State institutions in contracts
with or furnishing supplies or performing work for such institutions.

Be it enacted by the General Assembly of Virginia:
Lowe § 18.1-411 of the Code of Virginia be amended and reenacted as
ollows:
§ 18.1-411. Members of any board of visitors, etc., contracting with
their institution.—If any member of the board of visitors or directors of
any State institution, or employee or agent thereof, or any trustee of any
public trust or fund, or any salaried officer of any such State institution
or of any such public trust or fund, contract or be interested in any contract
with such institution or with the governing authority of such public trust
or fund in any manner for furnishing supplies or performing any work
for such institution, or for the governing authority of such trust or fund,
he shall be fined not exceeding five hundred dollars. — ;
For the purposes of this section, the words “furnishing. supplies or
performing any work” shall not be held to include the depositing of funds
in, or the borrowing of funds from or the serving as agent or trustee by,
any bank in which any member of the board of visitors or directors of
any State institution, or employee or agent thereof, or any trustee of any
public trust or fund, or any salaried officer of any such public trust or
fund may be a director, officer or employee or have a stock interest; nor
shall such words include the purchase of services from any public service
corporation.
This section shall not prevent any director, officer, employee, or stock-
holder of a bank or of a public service corporation which, but for the pre-
ceding paragraph, would be deemed to be “furnishing supplies or per-
forming any work’ for any State institution or any public trust or fund,
from serving as a member of the board of visitors or directors of any
such State institution or as a trustee of any such public trust or fund, or
as a salaried officer of any such State institution or of any such public
trust or fund; nor shall this section affect the validity of any contract
which, under the preceding paragraph, is deemed not to be for “furntsh-
ing supplies or performing any work,” other provisions of the law to the
contrary notwithstanding.
2. An emergency exists and this act is in force from its passage.
