CHAPTER 14
An Act to amend and reenact 8§ 28-41 and 28-49.1, as amended, of
the Code of Virginia, relating, respectively, to the appointment of
the visitors of the College of William and Mary, and constituent
colleges of such College. (H 11]

Be it enacted by the General Assembly of Virginia:
1. That §§ 23-41 and 23-49.1, as amended, of the Code of Virginia, be
amended and reenacted as follows:
§ 23-41. (a) The board of visitors is to consist of * seventeen
members to be appointed by the Governor * three of whom may be non-
residents of Virginia, and the Superintendent of Public Instruction ex
officio. The visitors of the Colleges of William and Mary in office on
March seventh, nineteen hundred sixty-two, are hereby declared to be
visitors of the College of William and Mary in Virginia, and are con-
tinued in office until their respective terms would have otherwise expired.
(b) On or before March first, nineteen hundred sixty-two, and
biennially thereafter, the Governor shall appoint, for the term of four
years, the successors of the visitors whose terms are about to expire.
Thereafter, all visitors shall be appointed for terms of four years.
The Governor shall appoint for a term of four years the Superintendent
of Public Instruction as an ex officio visitor, such membership to be
vacated, however, with the termination of his tenure as Superintendent.
(c) All vacancies, whether occasioned by failure to make an ap-
pointment within the sixty days preceding any regular expiration as
required, or otherwise, are to be filled by the Governor for the unex-
term.
§ 23-49.1. (a) The College of William and Mary in Virginia, in
Williamsburg, the Richard Bland College, in Petersburg and the
Christopher Newport College, in Newport News shall be subject to the
supervision, management and control of the board of visitors of the
College of William and Mary in Virginia. Such colleges shall be separate
from each other and each college shall report directly to the board of
visitors through the president in the case of the College of William
and Mary in Virginia, and as the board of visitors may direct in case
of the two-year colleges.
(b) All property, property rights, duties, contracts and agree-
ments of the several colleges are vested in the board of visitors of the
College of William and Mary in Virginia. The chief executive officer
of the College of William and Mary in Virginia shall be the president;
the chief executive officer of such two-year colleges as may be author-
ized by the General Assembly and made by it integral parts of the
College of William and Mary in Virginia shall be designated as directors.
The board of visitors of the College of William and Mary in Virginia
is charged with the care and preservation of all property belonging to
the several colleges. With respect to the several colleges, the board of
visitors shall have the same powers as to fixing tuitions, fees, and other
charges, as to the appointment and removal of administrative officers,
professors, agents and employees, and the making of rules and regula-
tions, as are now vested in them with respect to the College of William
and Mary in Virginia; provided, that no four year degree shall be con-
ferred for completion of the course of instruction offered at the two-
year colleges at Newport News and Petersburg.
(c) Appropriations directly and indirectly from the State to the
several colleges shall be expended as directed by the board of visitors
of the College of William and Mary in Virginia.
(d) The board of visitors of the College of William and Mary in
Virginia is authorized and directed to prepare the bylaws for the
colleges and to publish the same and to define the functions of the several
colleges, and to specify the responsibilities of the chief executive officers,
all professors, teachers and agents of the several colleges, as the
may deem necessary.
(e) The board of visitors of the College of William and Mary in
Virginia shall * designate the organizational channel of coordination
and supervision of such two-year colleges as may be authorized by the
General Assembly * for administration by the board of visitors.
(f) The board of visitors is hereby empowered to choose distinc-
tive and appropriate titles for all constituent colleges, except those
named and except for the college at Williamsburg, which shall
be known as the College of William and Mary in Virginia.
