CHAPTER 9

An Act to amend and reenact § §1-111.88:1 of the Code of Virginia, relating
to the retirement of certain school teachers employed by corporations
providing elementary or secondary education so as to provide that its
provisions shall apply to any such corporation without regard to the
date of its organization. HI

Be it enacted by the General Assembly of Virginia:

1. That § 51-111.38:1 of the Code of Virginia be amended and reenacted
as follows:

§ 51-111.38:1. —Any corporation * providing elementary or secondary
education may by resolution duly adopted by its board of directors and ap-
proved by the Board of Trustees of the Virginia Supplemental Retirement
System elect to have teachers employed by it become eligible to participate
in the retirement system. Acceptance of the teachers employed by such
an employer for membership in the retirement system shall be optional with
the Board and if it shall approve their participation, then such teachers, as
members of the retirement system, shall participate therein as provided
in the provisions of this chapter.
