CHAPTER 91
An Act to authorize the Governor to appoint a commission to be known
as the Virginia Commission on Higher Education Facilities; to define
the duties of such commission and to appropriate funds necessary to
carry out the purposes of such commission.

Be it enacted by the General Assembly of Virginia:
1. The Governor is hereby authorized to appoint a commission, composed
of not more than seven members, which shall be broadly representative
of the public and of higher education (including junior colleges and tech-
nical institutions) in this State, to be known as the Virginia Commission
on Higher Education Facilities.
Each member shall hold office for a term of four years, except ap-
pointments to fill vacancies, which shall be made for the unexpired terms.
The members of the Commission shall receive no salaries, but shall be re-
imbursed for actual expenses incurred in attendance upon meetings, or
while othewise engaged in the discharge of their duties. Any member who
is not a salaried officer or employee of the State shall receive the sum of
twenty dollars a day for each day so engaged in the discharge of his duties.
The Commission shall select one of the members as its Chairman.
2. The Commission shall prepare and administer a plan for participation
in any United States government programs for granting financial assist-
ance to public and private nonprofit institutions of higher education for
providing academic facilities. The plan shall contain standards, criteria,
and methods for determining eligible projects for construction, and the
relative priorities for grants-in-aid of such construction.
8. The Commission shall be authorized to receive applications from
eligible institutions, and to assign priorities for projects on the basis of such
criteria, standards, and methods as provided in the plan.
4. The Commission shall be authorized to apply for and receive funds
provided for grants to institutions of higher education by the Higher
Education Facilities Act of 1963 or similar acts of Congress, to be expended
or administered as provided in such acts of Congress. Any funds received
by the Commission from the federal government or any other source for
providing academic facilities for institutions of higher education shall be
deposited in the State treasury to be disbursed by the Treasurer upon war-
rants of the Comptroller. Requisitions shall be signed by the Chairman
of the Commission.
Nothing in this act shall preclude any other agency, board, or officer
of the State from being designated as the directing or allocating agency,
board, or officer for the distribution of federal grants-in-aid, or the per-
formance of any duties to the extent necessary to qualify for, and to
receive, grants-in-aid for the program under the supervision and admin-
istration of the commission herein created.
5. The Commission may employ such agents, employees, or consultants
as may be necessary to carry out the purposes of this act.
6. There is hereby appropriated from the general revenues not otherwise
appropriated a sum sufficient estimated at $5,000 for the purpose of carry-
ing out the provisions of this act.
7. All offices, departments, commissions, boards, agencies and institu-
tions of the State are directed to cooperate with, and assist the Commission
herein created in carrying out the purposes of this act.
2. Anemergency exists and this act is in force from its passage.
