An Act to amend the Code of Virginia by adding in Title 23 thereof a
chapter numbered 11.1, containing sections numbered 28-155.1 through
23-155.10, to create a corporation composed of the Board of Visitors
of Radford College; to provide for the appointment, terms of office,
powers and duties of the members thereof and of the Board; to pre-
scribe the curriculum of the College; and to repeal Article 5 of Chapter
11 of Title 23 of the Code of Virginia, containing sections numbered
28-147 through 28-155, relating to certain of the same subjects.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Title 23 thereof a
chapter numbered 11.1, containing sections numbered 23-155.1 through
23-155.10, as follows:
§ 23-155.1. There is hereby established a corporation composed of
the Board of Visitors of Radford College under the style of “The Visitors
of Radford College’ in this chapter hereinafter referred to as the Board.
§ 23-155.2. The College shall be known as Radford College.
§ 23-155.3. All the rea] estate and personal property now existing
and heretofore standing in the name of the Board of Visitors of the Vir-
ginia Polytechnic Institute, located in Radford, and heretofore exclusively
used by Radford College, Woman’s Division of the Virginia Polytechnic
Institute, shall be transferred to and be known and taken as standing in
the name, and to be under the control, of The Visitors of Radford College.
Such real estate and personal property shall be the property of the Com-
monwealth.
§ 23-155.4. (a) The Board shall consist of twelve members of whom
eleven shall be appointed by the Governor; the Superintendent of Public
Instruction shall be a member, ex officio.
(b) In nineteen hundred sixty-four the Governor shall appoint the
eleven appointive members of the Board for terms beginning July one,
nineteen hundred sixty-four. Six of such members shall be appointed to
serve for four-year terms and five shall be appointed to serve for twc-year
terms. Successors to the members so appointed shall be appointed to serve
for terms of four years each. Vacancies occurring other than by expira-
tion of term shall be filled for the unexpired term. Of the persons so ap-
pointed two may be nonresidents of the State.
(c) All appointments shall be subject to confirmation by the General
Assembly. Members shall continue to hold office until their successors have
been appointed and have qualified.
§ 23-155.5. (a) The Governor may appoint visitors from a list of
qualified persons submitted to him, by the alumni association of the
Radford College, or its titular successor, on or before the first day of July
of any year in which the terms of any visitors will begin or expire.

illed.
(c) The Governor is not to be limited in his appointments to the per-
sons so nominated.
§ 23-155.6. No person except the ex officio member shall be eligible
to serve for or during more than two successive terms.
§ 23-155.7. The Board shall be vested with all the rights and powers
conferred by the provisions of this chapter in so far as the same are not
inconsistent with the laws of the State.
The Board shall control and expend the funds of the College and any
appropriation hereafter provided, and shall make all needful rules and
regulations concerning the College, appoint the president, who shall be its
chief executive officer, and all professors, teachers and agents, and fix
their salaries, and generally direct the affairs of the College.
§ 23-155.8. The Board may fix the rates charged the students of the
College for tuition, fees and other necessary charges.
§ 23-155.9. The Board shall have the right to confer degrees.
§ 23-155.10. The curriculum of Radford College shall embrace such
branches of learning as relate to teaching in the public free schools of
Virginia, without excluding other studies in the arts and sciences.
2. Article 5 of Chapter 11 of Title 23 of the Code of Virginia, containing
sections numbered 23-147 through 23-155, is repealed.
