An Act to amend and reenact § 28-115 of the Code of Virginia, relating
to appointment of the board of visitors of Virginia Polytechnic
Institute.

Be it enacted by the General Assembly of Virginia:
1. That § 23-115 of the Code of Virginia, be amended and reenacted
as follows:
§ 23-115. The board of visitors is to consist of fifteen members,
thirteen of whom shall be appointed by the Governor, * and two of whom
shall be the President of the Board of Agriculture and Immigration and
the Superintendent of Public Instruction, both ex officio. Of the members
appointed by the Governor, three may be nonresidents. The visitors in
office on April ninth, nineteen hundred and forty-five, are continued in
office until the end of their respective terms, or until June thirtieth, nine-
teen hundred and forty-five, whichever last occurs.
As soon as practicable after April ninth, nineteen hundred and forty-
five the Governor shall appoint four members to fill the unexpired por-
tions of the terms which began on July first, nineteen hundred and forty-
four, and shall appoint three additional members for new terms of twce
years and two for new terms of four years, each term beginning July
first, nineteen hundred forty-five. He shall, in addition, appoint the Super-
intendent of Public Instruction as an ex officio member for a term of twa
years, and the President of the State Board of Agriculture and Immigra-
tion as an ex officio member for a term of four years, such terms to
begin July first, nineteen hundred forty-five; provided that, if the tenure
in office as Superintendent or President of such ex officio members expires
within that time, the Governor shall appoint such member’s successor to
fill the unexpired term. Such Superintendent and President shall remain
eligible for appointment as ex officio members so long as they continue in
office as Superintendent or President. All appointments for full terms, as
well as to fill vacancies, shall be made by the Governor subject to confir-
mation by the Senate.
