An Act to amend and reenact §§ 15.1-1385 and 15.1-186 of the Code of
Virginia, relating to the taking of fingerprints by police authorities
so as to authorize the taking of photographs of certain versons
charged with crime in certain cases.

Be it enacted by the General Assembly of Virginia:
1. That §§ 15.1-135 and 15.1-136, of the Code of Virginia be amended
and reenacted as follows:
§ 15.1-135. All duly constituted police authorities of counties, cities
and towns are hereby authorized to take the fingerprints and photograph
of any person arrested and charged by them with a felony, and such au-
thorities of cities having a population of more than * seventy thousand
and any county having a population of more than four thousand per square
mile are further authorized to take the fingerprints of any person arrested
and charged by them with a misdemeanor, other than a misdemeanor
under Title 46. i, where such person is taken into physical custody by such
police authorities.
§ 15.1-136. The judge of a county court or municipal court may, in
his discretion, on motion of the attorney for the Commonwealth, require the
duly constituted police officers of the county, city or town within the ter-
ritorial jurisdiction of such court to take the fingerprints and photograph
of any other person who has been arrested and charged with a misdemeanor
other than a misdemeanor which is a violation of any provision of Title
46.1 of the Code.
