CHAPTER 405
An Act to amend the Code of Virginia, by adding in Title 28 thereof a
chapter numbered 15, containing sections numbered 28-182 through
28-208, creating a Board and Department of Technical Education, and
prescribing their powers and duties. [H 205]

Be it enacted by the General Assembly of Virginia: __
1. That the Code of Virginia be amended by adding in Title 23 thereof
pes ee 15, containing sections numbered 28-182 through 23-
03, as follows:
CHAPTER 15.
Area Vocational and Technical Schools
Article 1
' State Board of Technical Education
§ 28-182. There is hereby created the State Board of Technical Edu-
cation. Whenever the words “Board” or “State Board” are used in this
chapter, they shall mean the State Board of Technical Education.
“Vocational and Technical Education” means vocational or technical
training, or retraining, which is given in school, or classes (including field
or laboratory work incidental thereto), under public supervision and con-
trol, exclusive of those vocational and technical programs provided and ad-
ministered by, or through, the public school system, or institutions operated
by four-year colleges, and universities of the State, and is conducted as
part of a program designed to fit individuals for gainful employment as
semi-skilled, or skilled, workers or technicians in recognized “ecupations.
“Area, Vocational and Technical Schools” means a vocational or tech-
nical school used exclusively, or principally, for providing vocational and
technical education to persons who have completed, or left, high school,
or are recommended for transfer by the school last attended, and who
are available for full-time study in preparation for entering the labor
market, or for part-time study after entering the labor market.
§ 23-183. The Board shall consist of nine members, to be appointed
as hereinafter set forth. One member shall be appointed by the State
Council of Higher Education for Virginia from the membership or staff
thereof, and he shall serve at the pleasure of the State Council of Higher
Education for Virginia. One member shall be appointed by the State Board
of Education from the membership or staff thereof, and he shall serve at
the pleasure of the State Board of Education. One member shall be ap-
pointed by the Governor from either the membership of the Advisory Board
on Industrial Development and Planning or the staff of the Division of
Industrial Development and Planning, who shall serve at the pleasure of
the Governor. Six members shall be appointed by the Governor from the
State at large, subject to confirmation by the General Assembly if in
session, and if not, then at its next succeeding session. The first appoint-
ments of at large members shall be two members for two years, two mem-
bers for three years and two members for four years, and thereafter all
such appointments shall be made for a term of four years, except appoint-
ments to fill vacancies which shall be for the unexpired terms. No at large
member shall be eligible to serve more than two successive terms of four
years; provided that a person appointed to fill a vacancy may serve two
additional successive terms. No director, officer, or employee of a school
subject to the control of the Board shall be appointed a member of the
oard.
§ 23-184. The Board shall select a chairman from its membership,
and under rules adopted by itself may elect one of its members as vice-
§ 28-185. The members of the Board shall receive no salaries. They
shall be paid their necessary traveling and other expenses incurred
in attendance upon meetings, or while otherwise engaged in the dis-
charge of their duties. The at large members and, unless serving as ex
officio on such Board or Council, any member who is also a member of the
State Board of Education, the Advisory Board on Industrial Development
and Planning, or the State Council of Higher Education for Virginia, shall
be paid the sum of twenty dollars a day for each day or portion thereof in
which they are engaged in the performance of their duties.
§ 23-186. Before entering upon the discharge of his duties, each
member of the Board shall take an oath that he will faithfully and honestly
execute the duties of his office during his continuance therein.
§ 23-187. The Board shall meet at least four times annually, and on
call of the chairman when in his opinion additional meetings are expedient
or necessary.
§ 23-188. Five members of the Board shall constitute a quorum for
purposes.
3 23-189. The main office of the Board shall be in the city of Rich-
mond.
§ 23-190. The Board shall be empowered to promulgate necessary
rules and regulations for carrying out the purposes of this chapter; to pre-
pare and administer a plan providing standards and criteria for the es-
tablishment, development, maintenance and administration of area voca-
tional and technical schools under its authority.
§ 28-191. The State Board of Technical Education shall perform such
duties as may be prescribed by law. The Board shall develop, administer
and supervise new area vocational and technical schools established by the
State subsequent to January one, nineteen hundred sixty-four, and such
other institutions and programs in the field of vocational and technical
education which it may be directed from time to time by the General As-
sembly to establish. Subject to the approval of the Governor, the Board
may assume the development, supervision, and administration of any such
institutions established and operated by the political subdivisions of the
State, the supervision, administration and development of which the Board
may be requested by such political subdivisions to assume.
The Board may designate any such area vocational and technical
school as a technical education center or other appropriate name.
The Board shall determine the locations for area vocational and tech-
nical schools established by the State subsequent to January one, nineteen
hundred sixty-four, and shall determine the requirements for participation
by the political subdivisions of the State in the establishment and operation
of such schools.
The Board shall determine the tuition fees to be charged students in
the area vocational and technical schools established as hereinabove pro-
vided.
The Board may recommend the type of vocational and technical edu-
cation required in each area of the State. The Board shall determine the
curriculum for each course of instruction offered in schools under its ad-
ministration. Such curricula shall be reviewed periodically by the Director
of Technical Education under the supervision of the Board, and shall be
altered when necessary to keep pace with developments in the field of voca-
tional and technical education.
The Board shall coordinate its efforts in the field of vocational and
technical education, where feasible, with all other institutions or agencies,
public or private, offering vocational and technical education, and shall
assist such institutions and agencies as far as practicable in determining
the need for vocational and technical education, and in maintaining ade-
quate standards of instruction.
Article 2
Department of Technical Education
§ 28-192. There is hereby created the Department of Technical
Education, hereinafter sometimes called the Department.
§ 23-198. The Director of Technical Education, hereinafter some-
times called the Director, shall be appointed by the Governor, subject to
confirmation by the General Assembly, for a term coincident with that of
the Governor making the appointment. Any vacancy shall be filled by
appointment by the Governor, subject to the confirmation of the General
Assembly. The Director shall be the chief executive officer of the Depart-
ment. The Director shall, without additional compensation, serve as secre-
tary to the State Board of Technical Education.
§ 28-194. The salary of the Director shall be fixed by the General
Assembly, and he shall be allowed in addition to his salary, for his neces-
sary traveling expenses while engaged in the duties of his office, such sum
as may be appropriated by law.
§ 23-195. Before entering upon the discharge of the duties of his
office, the Director shall qualify by taking and subscribing the oath re-
quired of all officers of the State.
§ 23-196. It shall be the duty of the Director of Technical Educa-
tion to formulate such rules and regulations, and provide such assistance
in this office as shall be necessary for the proper performance of the duties
prescribed by the provisions of this chapter.
The State Board of Technical Education shall prescribe the duties of
the Director, in addition to those duties otherwise prescribed for him by
law, and, in its discretion, approve the appointment by the Director of such
agents and employees as may be needed by the Director and the Depart-
ment in the exercise of the functions, duties and powers conferred and
imposed by law upon him and the Department, and in order to effect a
proper organization and to carry out its duties.
§ 23-197. The functions, duties, powers and titles of the agents and
employees provided for in the preceding section, their salaries and remuner-
ations, not in excess provided therefor by law, shall be fixed by the
Director subject to the provisions of chapter 9 of Title 2.
§ 23-198. The proper bonds shall be required of all agents and
employees who shall handle any funds which may come into custody of the
Department. The premiums on the bonds shall be paid from funds appro-
priated by the State for the administration of the provisions of this title.
§ 23-199. The Director shall submit to the Governor and publish an
annual report, not later than four months after the close of each fiscal
year, showing for each year the total amount of money paid or distributed
by the Department, the total number of persons receiving instruction
during such period, and such other information as the Director may deem
advisable to show the operation of the Department.
§ 23-200. The Director shall prescribe the forms of applications,
reports, affidavits and such other forms as shall be required in the admin-
istration of this chapter.
§ 23-201. Subject to the directions of the Board, the Director shall
cooperate with the agencies of the United States in relation to matters set
forth in this chapter, and in any reasonable manner that may be necessary
for the State to qualify for and to receive grants or aid from such federal
agencies.
Nothing in this chapter shall preclude other agency, board or
officer of the State from being designated as the directing or allocating
agency, board or officer for the distribution of federal grants-in-aid or the
performance of other duties to the extent necessary to qualify for and to
receive grants-in-aid for programs and schools under the administration
of the State Board of Technical Education.
§ 23-202. The Director is authorized to receive, for and on behalf
of the State and its subdivisions, from the United States and agencies
thereof, and from any and all other sources, grants-in-aid and gifts, made
for the purpose of providing, or to assist in providing vocational and tech-
nical education, including expenses of administration. All such funds shall
be paid into the State treasury.
§ 23-203. The Director shall enforce the standards established by the
Board for personnel employed in the administration of this chapter and
remove or cause to be removed each employee who does not meet such
standards.
