CHAPTER 364
An Act to authorize the Governor and the Attorney General to execute, in
the name of the Commonwealth, a deed conveying unto the United
States of America certain formerly submerged lands in the Elizabeth
River as required by the U. S. Naval Station, Norfolk, Virginia, for
national defense purposes. S889)

Whereas, the United States of America is the owner of a large area
of land abutting on the Elizabeth River in Norfolk, Virginia, which is
designated and used as the Destroyer-Submarine Pier area of the U. S.
Naval Station, Norfolk, Virginia; and
Whereas, the United States, by bulkheading and filling, has reclaimed
certain contiguous and formerly submerged lands in the Elizabeth River
and has constructed extensive improvements thereon in the interest of
the national defense; and
Whereas, the title to said lands, as acquired by the United States
extends only to the low water line of the Elizabeth River as it existed
prior to such bulkheading and filling; and
Whereas, it is desirable that the Commonwealth convey unto the
eee — all of its right, title and interest in and to such reclaimed

Whereas, the conveyance of such reclaimed lands unto the United
States is in the best interest of the Commonwealth in promoting the
national defense and the Port of Hampton Roads; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. The Governor and the Attorney General are hereby authorized to
execute, in the name of the Commonwealth of Virginia, and deliver to
the United States of America, a proper deed of conveyance, under the
lesser seal of the Commonwealth, conveying subject to the jurisdictional
and other limitations and reservations contained in 88 7-19 and
7-25 of the Code of Virginia, all of its right, title and interest in and to
the following described property:
FIRST: All that certain tract, piece or parcel of land situate, lying
and being in the City of Norfolk, Virginia, consisting of formerly sub-
merged lands reclaimed from the bed of the Elizabeth River, now form-
ing a part of the Destroyer-Submarine Pier area of the U. S. Naval Sta-
tion, Norfolk, Virginia, and being more particularly bounded and de-
scribed as follows, to-wit:
Beginning at a point marked by a rail monument in the western
right-of-way line of Hampton Boulevard, said point being the northeastern
corner and the same point of beginning of those certain lands particularly
described in that certain deed, dated 23 April 1957, from the Norfolk
and Western Railway Company to the United States of America, con-
veying 29.543 acres, which deed is duly recorded in the Clerk’s Office of
the Corporation Court of the City of Norfolk in Deed Book 751 at page
410; running thence South 4° 01’ 00” East and along the western right-
of-way line of Hampton Boulevard, 450.15 feet to a point; thence west-
erly and along the southern boundary line of the aforementioned 29.543
acre tract the following five (5) courses and distances: South 84° 58’ 00”
West, 1676.00 feet; South 3° 54’ 00” East, 17.60 feet; South 85° 59’ 00”
West, 189.84 feet ; North 2° 57’ 50” West 148.88 feet; and South 86° 00” 08”
West, 1189.03 feet to the TRUE POINT OF BEGINNING of the lands
herein described; running thence from said TRUE POINT OF BEGIN-
NING North 4° 00’ 06” West, and along the bulkhead of the United
States, 348.25 feet to a point, said point being the northwestern corner
of the aforesaid 29.543-acre tract; thence leaving said bulkhead and
running North 85° 59’ 00” East, along the northern boundary line of
the aforesaid 29.543-acre tract, to a point in the former mean low water
line as the same existed prior to the bulkheading and reclamation of the
formerly submerged lands described herein; thence southerly, and along
the meanders of the said former mean low water line, toa point in the
bulkhead of the United States, said point being also in a southern bound-
ary line of the aforesaid 29.548-acre tract; thence South 86° 00’ 08”
West and along the last mentioned boundary line, to the TRUE POINT
OF BEGINNING.
SECOND: All that certain tract, piece or parcel of land situate,
lying and being in the City of Norfolk, Virginia, contiguous to the lands
described in “FIRST” above, consisting of formerly submerged lands
reclaimed from the bed of the Elizabeth River, now forming a part of the
Destroyer-Submarine pier area of the U. S. Naval Station, Norfolk, Vir-
ginia, and being more particularly bounded and described as follows, to-wit:
Beginning at a point marked by a rail monument in the western
right-of-way line of Hampton Boulevard, being the same point of be-
ginning described in Parcel “FIRST” above, running thence South 85°
59’ 00” West, and along the southern property line of the lands described
in that certain deed from the Norfolk and Western Railway Company to
the United States of America, conveying 105.8 acres, which deed was
duly recorded in the Clerk’s Office of the Corporation Court of the City
of Norfolk on 6 November 1963, in Deed Book 956 at page 601, a dis-
tance of 3401.52 feet to a point in the established United States bulkhead
line in the Elizabeth River and the TRUE POINT OF BEGINNING of
the lands herein described; running thence North 2° 49’ 25” East, and
along the said established United States bulkhead line, 1609.28 feet to a
point; said point being the northwestern corner of the aforesaid 105.8-
acre tract; thence leaving said bulkhead line, and running easterly and
southeasterly along the northern boundary line of the aforesaid 105.8-acre
tract, the following six (6) courses and distances: North 86° 49 23”
East, 158.76 feet; South 04° 01’ 00” East, 8.18 feet; South 51° 02’ 48”
East, 262.46 feet; South 86° 49’ 39” East, 171.01 feet; South 89° 59’ 26”
East, 66.32 feet; and North 85° 59 00” East, to a point in the former
mean low water line as the same existed prior to the bulkheading and
reclamation of the formerly submerged lands described herein; thence
southerly, and along the meanders of said former mean low water line,
to a point in the northern boundary line of the lands described in Parcel
“FIRST” above, common to the southern boundary line of the aforesaid
105.8-acre tract; thence South 89° 59’ 00” West, and along the aforesaid
common boundary line, to the TRUE POINT OF BEGINNING.
2. An emergency exists and this act is in force from its passage.
