CHAPTER 276
An Act to amend the Code of Virginia by adding in Title 22 a chapter
numbered 15.1 containing sections numbered 22-880.1 through 22-
830.11, so as to establish the Virginia Board of Vocational Rehabili-
tation and to prescribe its powers and duties; to provide for the ap-
pointment, terms and compensation of the members thereof; to pro-
vide for other matters in connection with the foregoing, and to repeal
§§ 22-824.1 through 22-829 of the Code of Virginia, relating to the
same subjects.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding in Title 22 a chapter
numbered 15.1 containing sections numbered 22-330.1 through 22-330.11,
as follows:
§ 22-330.1. (a) There is hereby established the Virginia Board of
Vocational Rehabilitation, hereinafter in this chapter referred to as the
Board.
(b) The Board shall be composed of seven members appointed by
the Governor for terms of four years, but the first appointments here-
under shall be made as follows: two members shall be appointed for
terms of four years, two members shall be appointed for terms of three
years, two members shall be appointed for terms of two years and one
member shall be appointed for a term of one year. Their successors
shall be appointed for terms of four years, but vacancies occurring other
than by expiration of term shall be filled for the unexpired term. All
terms shall commence July one of the year in which the term is to begin.
(c) No person shall serve as a member of the Board for more than
two consecutive terms without the lapse of a period of four years be-
tween terms, but any person who has served two years or less of a
term shall not be deemed to have served a full term.
(d) The members of the Board shall receive no salaries, but shall
be reimbursed for actual expenses incurred in attendance upon meet-
ings, or while otherwise engaged in the discharge of their duties. Any
member who is not a salaried officer or employee of the State shall re-
ceive the sum of twenty dollars a day for each day so engaged in the
discharge of his duties.
§ 22-330.2. The Board shall meet at least four times each year
and at other times on call of the Chairman or at the written request of
a majority of the members. The Board shall elect one of its members
Chairman and shall elect a Secretary who may, but need not, be a mem-
ber of the Board.
§ 22-330.3. All powers, duties, functions, funds, records, and prop-
erty of the State Board of Education and the State Department of Edu-
cation relating to the Division of Vocational Rehabilitation, and the
Woodrow Wilson Rehabilitation Center are hereby transferred to and
vested in the Board.
§ 22-330.4. The Board shall appoint a Director of Vocational Re-
habilitation who shall serve as its chief executive officer and discharge
such functions as are conferred upon him by the Board or imposed upon
him by law.
The Board may employ such persons as may be required to discharge
its duties, and, in accordance with law, may fix their compensation.
§ 22-330.5. In accordance with the provisions of chapter 3 of Title
23, the Board may issue revenue bonds on behalf of the Woodrow
Wilson Rehabilitation Center or other facilities of a like nature over
which it has supervision.
§ 22-330.6. The Board is authorized to establish out of such funds
as are available a Department of Vocational Rehabilitation for the State,
the purpose of which Department shall be to study the problems of vo-
cation rehabilitation, to organize, supervise and otherwise provide the
necessary services and facilities required to prepare persons disabled in
industry or otherwise for useful and productive lives including suitable
employment.
§ 22-330.7. The State of Virginia, through the General Assembly,
accepts the provisions and benefits of the acts of Congress of the United
States for the promotion of vocational rehabilitation of persons disabled
in industry or otherwise and their return to civil employment and will
observe and comply with all requirements of such acts.
§ 22-330.8. The State Treasurer is hereby designated and appointed
custodian of all moneys received by the State from appropriations made
by the Congress of the United States for the vocational rehabilitation
of persons disabled in industry or otherwise, and is authorized to re-
ceive and provide for the proper custody of the same and to make dis-
bursements therefrom upon the order of the Board herein designated.
§ 22-330.9. The Board provided for in § 22-330.1, is designated as
the State Board for the purpose of cooperating with the federal govern-
ment in carrying out the provisions and purposes of the federal act
providing for the vocational rehabilitation of persons disabled in in-
dustry or otherwise, and is empowered and directed to cooperate with
the federal government in the administration of such act of Congress;
to prescribe and provide such courses of vocational training and other
services as may be necessary for the vocational rehabilitation of persons
disabled in industry or otherwise and provide for the supervision of
such training and services; to appoint such assistants as may be neces-
sary to administer this chapter and the act of Congress in this State;
and to direct the disbursement and administer the use of all funds pro-
vided by the federal government to this State for the vocational rehabili-
tation of such persons.
§ 22-330.10. The Board shall be empowered to cooperate as afore-
said with the Industrial Commission of Virginia and other public and
private agencies serving the disabled, in formulating a plan of coopera-
tion in accordance with this chapter and the act of Congress for Voca-
tional Rehabilitation for persons disabled in industry or otherwise, such
plan to become effective when approved by the respective boards of the
cooperating agencies.
§ 22-330.11. The Board designated to cooperate as aforesaid in the
administration of the federal act is hereby authorized and empowered to
receive such gifts and donations, either from public or private sources,
as may be offered unconditionally or under such conditions related to
the vocational rehabilitation of persons disabled in industry or otherwise
as in the judgment of the Board are proper and consistent with this
chapter. All moneys received as gifts or donations shall be deposited in
the State treasury and shall constitute a permanent fund to be called
the special fund for the vocational rehabilitation of disabled persons, to
be used by the Board to defray the expenses of vocational rehabilitation for
persons undergoing rehabilitation services and constructing, equipping,
and operating necessary rehabilitation facilities. A full report of all
gifts and donations offered and accepted, together with the names of the
donors and the respective amounts contributed by each, and all dis-
bursements therefrom shall be submitted annually to the Governor of
this State by the Board.
2. §§ 22-324.1 through 22-329 of the Code of Virginia are repealed.
