CHAPTER 253
An Act to amend and reenact 8§ 46.1-19 and 46.1-20 of the Code of Vir-
ginia, relating to the composition and membership of the Rectprocity
Board, and reciprocal agreements entered into by the Governor; and
to amend the Code of Virginia by adding a section numbered 46.1-19.1,
requiring the State Corporation Commission to publish annually a
list of states with which certain reciprocal agreements have been made
and to furnish copies of such list to certain officials and agencies.

Be it enacted by the General Assembly of Virginia:
1. That §§ 46.1-19 and 46.1-20 of the Code of Virginia be amended and
reenacted, and that the Code of Virginia be amended by adding a section
numbered 46.1-19.1, as follows:
§ 46.1-19. The Reciprocity Board, hereinafter called the Board,
shall consist of three ex-officio members, namely, the Commissioner of
the Division of Motor Vehicles, the State Highway Commissioner, and one
of the members of the State Corporation Commission. * A majority of the
members of the Board shall constitute a quorum and the action of the
majority of the members in attendance at any meeting shall be the action
of the Board. Whenever a member of the Board is absent from a meeting
of the Board, he may designate one of his assistants or employees to
attend on his behalf. Any such assistant or employee shall be entitled to
participate in the discussion and proceedings of the Board, but he shall
not be entitled to vote.
§ 46.1-19.1. The State Corporation Commission shall annually pre-
pare and publish a list showing, as of June thirty of each year, those
states, including the District of Columbia, with which reciprocal agree-
ments, unilateral, bilateral or otherwise, have been made, or are in force,
under the provisions of § 46.1-20 of the Code. Copies of the list shall
be mailed to the Superintendent of State Police, Attorneys for the Common-
wealth, and judges of all courts which have criminal jurisdiction; each
such list shall be accompanied by a statement of the law requiring the
regtstration and licensing of motor vehicles of all kinds and the exemptions
therefrom.
§ 46.1-20. (a) The Governor may, with the advice of the Board,
enter into reciprocal agreements on behalf of the Commonwealth with
the appropriate authorities of any state in the United States, or of the
District of Columbia, with respect to all taxes imposed by this State and
by any such other state on motor vehicles, or on the operation of motor
vehicles, or upon any transaction incident to the operation of motor
vehicles, provided, however, that no reciprocal agreement or other similar
arrangement shall be entered into with respect to the road tax imposed
by article 12, § 58-627 et seq., chapter 12, Title 58, either under this
section or any other section.
(b) Except as hereinabove provided, all agreements entered into by
the Governor with respect to any subject of reciprocity as to which pro-
vision is expressly made by statute shall conform to the provisions of such
statute. As to any other subject of reciprocity appropriate to the powers
vested in the Governor by this section, the Governor may, with the advice
of the Board, agree to such terms and conditions as in his judgment are
best calculated to promote the interests of the Commonwealth. Except as
nereinabove provided, it is the policy of this Commonwealth to grant
reciprocity to the residents of another state when such state grants re-
“iprocity to the residents of this Commonwealth.
(c) All agreements entered into by the Governor pursuant to thts
section shall be reduced to writing, and a copy shall be furnished the
Secretary of the Commonwealth, each member of the Reciprocity Board
and the Superintendent of State Police.
