An Act to authorize the Governor, on behalf of the State of Virginia, to
convey certain submerged and formerly submerged lands to the city
of Norfolk.

Whereas, the city of Norfolk, Virginia, has for many years, pursuant
to permits issued by the Corps of Army Engineers, filled certain submerged
lands in the city with solid, noncombustible material in connection with
the city incinerator; and
Whereas, it will be necessary for the city to continue to fill such land
within certain limits in order to effectively operate its incinerator; and
Whereas, it is now desirable that title to the said filled and submerged
land be vested in the city of Norfolk; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. § 1. That the Governor is hereby authorized to convey to the city
of Norfolk, Virginia, all right, title and interest of the State if any, in
and to the following:
All that certain piece or parcel of land containing approximately 76
acres, situate, lying and being in the city of Norfolk, Virginia, and being
more particularly bounded and described as follows:
So much of the land now or formerly comprising a portion of the
bottom of the Elizabeth River adjoining property conveyed to the city of
Norfolk, Virginia, by deed dated May 17, 1944, recorded in the office of
the Clerk of the Corporation Court of the city of Norfolk, Virginia, in
Deed Book 422, page 275, said land being bounded on the north by the
northern boundary of said property of the city of Norfolk and the pro-
longation westwardly thereof; on the west by the bulkhead line shown on
Harbor line map by the Corps of Engineers, approved April 15, 1930,
Corps of Engineers File No. N-1-8064 (7) (Sheet 11 of 18) ; on the south
by the dividing line between property owned by the city of Norfolk,
Virginia, and property owned by the Norfolk and Western Railway Com-
pany and the prolongation westwardly of said line; and on the east by the
mean low water line of the Elizabeth River as shown on “Plat showing
agreed line between the property of the Hampton Roads Terminal Corpo-
ration and that of Barton Myers & F. M. Killam” dated January 9, 1922,
recorded in the office of the Clerk of the Corporation Court in Map Book
4, page 183, and the portion of the low water line April, 1963, that extends
inland from the aforementioned low water line of January 9, 1922, both
of said lines being shown on a drawing entitled “Plat Showing the Lam-
berts Point Incinerator and adjoining properties owned by the city of
Norfolk, Scale 1” — 200’, December, 1963, Division of Surveys, Depart-
ment of Public Works, Norfolk, Virginia.” ;
Being more particularly described as follows: beginning at the point
where the bulkhead line shown on U. S. Corps of Engineers Harbor Line
Map approved April 15, 1930, Corps of Engineers File No. N-1-8064 (7)
(Sheet 11 of 18), is intersected by the northern line or the prolongation
westwardly thereof, of property conveyed to the city of Norfolk, Virginia,
by deed dated May 17, 1944, recorded in the office of the Clerk of the
Corporation Court in Deed Book 422, page 275, the co-ordinates of said
point of beginning being N 208,531.89, E 2,636,173.07, Virginia Plane
Co-ordinate System, South Zone as determined by published positions of
Corps of Engineers triangulation stations, “Brown 1951,” “Boll, 1959,”
and United States Coast and Geodetic Survey, ‘‘Craney Island Light,
1945.”"; thence along the northern line of the property conveyed to the
city of Norfolk as aforesaid S 78° 03’ 36” E, 1992 feet, more or less to the
low water line of the Elizabeth River as shown on the aforementioned
plat showing the “Lamberts Incinerator and Adjoining Properties” dated
December, 1963; thence southwestwardly along said low water line 550
feet, more or less, to the low water line shown on plat dated January 9,
1922, recorded in the office of the Clerk of the Corporation Court of
Norfolk, Virginia, in Map Book 4, page 133; thence in a generally south-
westwardly direction along the low water line shown on said plat to a
point in the present dividing line between property owned by the city of
Norfolk, Virginia, and property owned by the Norfolk & Western Rail-
way Company; thence S 80° 59’ 24” W, 370 feet, more or less, along said
line to a point; thence continuing along said line S 68° 49’ 54” W, 788.68
feet ; thence along said dividing line N 79° 23’ 36” W, 1121.01 feet to a point
in the aforementioned bulkhead line, the co-ordinates of which are N
206,590.19; E 2,635,343.46, Virginia Plane Co-ordinate System, South
Zone, according to the same determination used for the point of beginning
herein; thence along said bulkhead line N 23° 08’ 06” E, 2111.51 feet to
the point of beginning. Containing about 76 acres.
§ 2. The deed conveying the aforesaid property shall be prepared by
the Attorney General and shall contain such covenants as may be appro-
priate under the circumstances. —
2. An emergency exists and this act is in force from its passage.
