CHAPTER 110
An Act to provide for the acquisition by certain cities of property for
certain purposes; for conveyance thereof under certain circumstances
to the State or federal governments; and providing for the exercise
of the power of eminent domain in connection therewith. rH 815}

Be it enacted by the General Assembly of Virginia:
1. § 1. Any city having a population of not less than ninety-five
thousand and not more than one hundred ten thousand may acquire by
purchase, lease, gift or condemnation property adjacent to or in the
vicinity of the Blue Ridge Parkway, within or without the corporate limits
of such city and within any county adjacent thereto, for use as an exten-
sion of or addition or adjunct to said Blue Ridge Parkway, or for use as
public parks, playgrounds, recreational areas, or facilities, scenic areas,
historic spots or locations, or for access to any such place or places or may
set aside for such use any land or buildings owned or leased by such city;
and may develop, equip, and operate the same for any such purpose or pur-
poses or may transfer, assign, lease or convey, with or without monetary
consideration, at one time or from time to time, by lease or by general war-
ranty deed or deeds, to the Commonwealth of Virginia or to the United
States of America, or to any department, bureau, board or commission or
official thereof who is authorized to and who will agree to take, hold and use
or provide for the use of any such property for any of the aforesaid pur-
poses. Any such city, acquiring property for any of the aforesaid purposes
by exercise of the power of eminent domain may proceed as provided in
Chapter 1.1 of Title 25 of the Code of Virginia known as the “Virginia
General Condemnation Act’’, as the same may, from time to time,
amended, notwithstanding any provision of Chapter 4 of Title 25 of the
Code of Virginia, known as the “Public Park Condemnation Act” or any
other act to the contrary. This act shall be subject to the provisions of
§ 25-233 of the Code of Virginia.
2. An emergency exists and this act is in force from its passage.
