An Act to amend the Code of Virginia by adding a section numbered
28-21.1, relating to the authority of the Commissioner of Fisheries to
make certain contracts; to create the Special Public Oyster Rock
Replenishment Fund and provide how the same shall be disbursed.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia be amended by adding a section numbered
28-21.1 as follows:
§ 28-21.1. The Commissioner with the approval of the Commission
of Fisheries is authorized to contract with any person, firm or corporation
for the purpose of taking or dredging submerged oyster shells or any other
subaqueous materials from the tidal waters of the Commonwealth, and
shall have the authority to plant, use or sell such shells or other materials
in whatever manner the Commission deems to be in the best interests of
the Commonwealth.
All funds received or collected under this section shall be paid into
the State treasury to the credit of a fund to be known as the Special Public
Oyster Rock Replenishment Fund for the purposes of such fund. Expendi-
tures and disbursements from such fund shall be made by the State
Treasurer on warrants of the Comptroller issued on vouchers signed by
such person or persons as shall be so authorized and designated by the
Commission of Fisheries.
2. An emergency exists and this act is in force from its passage.
