An Act to amend and reenact § 8-749 of the Code of Virginia, relating to
payment of certain claims against the State. rH 781]

Be it enacted by the General Assembly of Virginia:
a That § 8-749 of the Code of Virginia be amended and reenacted as
ollows:
§ 8-749. Money thus paid into the State treasury shall be paid there-
out to any person entitled thereto, who has not asserted a claim to the same
in the suit or proceeding in which it was held as aforesaid, upon satis-
factory proof that he is so entitled. If the claim does not exceed two
hundred dollars, it may be presented to and allowed by the Comptroller
upon the proof aforesaid. If the claim so presented be rejected by the
Comptroller, or if the claim exceed two hundred dollars, the claimant may
proceed for its recovery in the circuit court of the city of Richmond in
the manner provided in §§ 8-752 to 8-757. If, in such proceeding, the claim
be established, the net amount thereof, after deducting costs and other
proper charges, shall be paid to the claimant out of the treasury on the
warrant of the Comptroller. The limitation prescribed by §§ * 2-198 and
8-757, shall apply to any claim presented or asserted under this section.
