An Act to create and constitute a political subdivision known as Tidewater
Airport Commission.

Be it enacted by the General Assembly of Virginia:
1. §1. “Commission” as used herein, shall mean Tidewater Airport
Commission established under the provisions of Article 2, Chapter 3, Title
5 of the Code of Virginia, by the joint action of the counties of Southamp-
ton, Norfolk, Princess Anne, Isle of Wight and Nansemond, and the cities
of Franklin, Suffolk, Virginia Beach, South Norfolk, Norfolk and Ports-
mouth, and the town of Smithfield.
§ 2. The Commission is hereby created and constituted a political
subdivision of the counties of Southampton, Norfolk, Princess Anne,
Isle of Wight and Nansemond, and the cities of Franklin, Suffolk,
Virginia Beach, South Norfolk, Norfolk and Portsmouth, and the town of
Smithfield. The exercise of the powers and duties conferred upon the
Commission by the said counties, cities and town by their respective ordi-
nances with respect to the construction, operation and maintenance oI an
airport, and the acquisition of land necessary for such airport, shall be
deemed and held to be for the public use and in the performance of an
essential governmental function.
The Commission shall be composed of one member from each of the
participating counties, cities and town; which members shall be elected
by the governing body of the respective governmental unit they represent.
3. The Commission, in addition to the powers and duties delegated
to it by the participating counties and cities, shall have the following
powers:
To acquire by purchase, lease, or otherwise, all the property of any
person, partnership, association or corporation deemed necessary for the
establishment, use, operation and maintenance of an airport.
§ 4. No airport or other facility shall be acquired or established in
any county, city or town pursuant to the provisions hereof by purchase
or under the power of eminent domain without the consent of the govern-
ing body of any such county, city or town.
