An Act to authorize the Governor and the Attorney General to convey
an easement over certain real estate to R. E. Holland. rH 7203

Whereas, on April 15, 1949, R. E. Holland and others conveyed certain
real estate in Brookland District, county of Henrico, to the Commonwealth
of Virginia; and
Whereas, no easement was reserved in said deed for a sewer line; and
Whereas, it has become necessary that sewerage facilities be installed
on and about the property of R. E. Holland adjoining the real estate now
owned by the Commonwealth, but the said R. E. Holland is not able to
install such facilities because of the land now owned by the Commonwealth
and formerly owned by the said R. E. Holland; and
Whereas, it is only right that such easement should be conveyed to the
said R. E. Holland by the Commonwealth; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. That the Governor and the Attorney General are hereby authorized,
subject to negotiations, to grant and convey by proper deed a fifteen foot
sewer easement to R. E. Holland; the description of said easement being
as follows:
Beginning at a corner, said corner being the northeast corner of a
3ix acre tract of land owned by the Commonwealth of Virginia lying east
of Staples Mill Road and adjoining the west line of the property of the
R.F. & P. Railroad Company, said easement to commence at the aforesaid
point and being fifteen feet in width, its eastern line being the eastern
line of the said six acres of land belonging to the Commonwealth of
Virginia, and thence running 8S. 7° 08’ E. a distance of one hundred fifty
feet, more or less, on its eastern line and one hundred fifty-eight feet, more
or less, on its western line to a point where said easement will connect
with an existing twenty foot sewer easement. For a more particular
description of said easement reference is hereby made to a plat of survey
by Charles H. Fleet & Associates, Civil Engineers and Surveyors, Rich-
mond, Virginia, dated February 6, 1962, whereon the said fifteen foot
easement is designated as “Proposed 15 Foot Sewer Easement”.
The property over which said easement is to run is a part of the
same property conveyed to the Commonwealth of Virginia by R. E.
Holland, et al, by deed dated April fifteen, nineteen hundred forty-nine,
recorded April twenty-one, nineteen hundred forty-nine, Clerk’s Office,
Circuit Court of Henrico County, Virginia, in Deed Book 468, page 466.
2. An emergency exists and this act is in force from its passage.
