An Act to authorize the Board of Visitors of Virginia Polytechnic Institute
to convey certain property to Blacksburg-Virginia Polytechnic Instt-
tute Sanitation Authority; to authorize such board to grant certain
easements; and to appropriate the proceeds from any such transfer.

Be it enacted by the General Assembly of Virginia: -
1. § 1. Subject to the approval of the Governor, the Board of Visitors
of Virginia Polytechnic Institute is authorized and empowered to convey
by deed, approved by the Attorney General, to Blacksburg-Virginia Poly-
technic Institute Sanitation Authority, the following described property,
together with all improvements thereon, situate, lying, and being in the
Blacksburg Magisterial District in Montgomery County, Virginia, more
particularly described as follows:
BEGINNING at a point on the center line of State Route 657 and
running with said center line South 24° 58’ West a distance of 25 feet, and
South 49° 01’ West a distance of 50 feet; thence South 51° 46’ West a
distance of 125 feet to a point in the roadway near the west edge, and with
said roadway South 41° 15’ West a distance of 130 feet and South 22° 17’
West a distance of 377 feet; thence continuing with the roadway South 3°
11’ West a distance of 91 feet to a point 60 feet West of Stroubles Creek,
and South 24° 35’ East a distance of 256 feet; thence South 28° 23’ East
a distance of 262.7 feet to an iron pipe; thence South 86° 25’ East a dis-
tance of 352.7 feet to an iron pipe; thence North 36° 35’ West a distance
of 292.4 feet to a stone; thence North 39° 43’ West a distance of 402.1 feet
to a railroad rail driven into ground in the center of a small branch;
thence continuing said bearing North 39° 43’ West a distance of 233.8 feet
to a fence corner; thence North 2° 42’ East a distance of 196.1 feet to a
stone; thence on a new line North 63° 15’ West a distance of 481.8 feet
to the beginning, the area being 12.5 acres, more or less.
Subject to the approval of the Governor, the Board of Visitors
of Virginia Polytechnic Institute is further authorized and empowered to
convey by deed, in form approved by the Attorney General, to Blacksburg-
Virginia Polytechnic Institute Sanitation Authority, such easements and
rights of way as they possess or hereafter acquire and as may be necessary,
convenient and required for sewerage rights of egress and ingress neces-
sary to the proper operation and maintenance of a sewage treatment
plant owned by Blacksburg-Virginia Polytechnic Institute Sanitation
Authority.
§ 3. The proceeds of any such sales shall be deposited in the State
treasury to the credit of the general fund.
§ 4. Notwithstanding any other section of this act to the contrary,
the Division of the Budget of the Commonwealth of Virginia shall make
a complete and comprehensive study of the present sewage treatment
plant owned and operated by the Virginia Polytechnic Institute and of
the related facilities, including without limitation, lines, pumping stations
and all other parts, portions and equipment thereof. Such engineering
study shall include consideration of the institutions, agencies and political
subdivisions being served thereby and, in connection therewith, the area
proposed to be served by any extension thereof. The study shall further
include the benefits, if any, to be gained by the Virginia Polytechnic Insti-
tute and the State from the transfer of the sewage treatment plant and
related facilities presently owned by it to any other political subdivision
and the costs to the Virginia Polytechnic Institute and State under the
present arrangement as well as the cost to the Virginia Polytechnic Insti-
tute and State under any proposed transfer to any other political sub-
division. The Division of the Budget shall begin such study forthwith and
shall make its report and recommendations to the Governor as soon as
may be. If the Governor, after consideration of such report, is of opinion
that the Virginia Polytechnic Institute should be authorized to transfer
the sewage treatment plant and related facilities to any other political sub-
division and to enter into a contract for the use of such transferred plant
and related facilities and the rate of charge to be made in connection
therewith, the Governor may authorize the Virginia Polytechnic Institute,
under such terms and conditions as he deems appropriate, to make such
transfer and to enter into such contract; if such authorization is granted
then §§ 1 through 8 of this act shall come into full force and effect but
until such authorization is granted by the Governor §§ 1 through 3 shall
be of no force and effect.
2. An emergency exists and § 4 of this act is in force from its passage,
and §§ 1 through 3 shall be in force as of such time the Governor grants
the authorization referred to in § 4.
