An Act to authorize the State Treasurer to make refund to counties of
payments of dog license receipts made to the State Treasurer, and to
prescribe the condition of entitlement to such refund. tH 5321

Be it enacted by the General Assembly of Virginia:
1. §1. Any county in which during the month of February, nineteen
hundred and sixty-one, a dog warden was appointed and assumed office
pursuant to the provisions of § 29-184.2 of the Code of Virginia shall be
entitled to a refund of the amount of payments made to the State Treas-
urer under § 29-206 of the gross receipts from dog licenses sold in such
county during the period from January first, nineteen hundred and sixty-
one, to March thirty-first, nineteen hundred and sixty-one. Such refund
shall be made by the State Treasurer, upon the warrant of the State Comp-
troller, out of the game protection fund upon satisfactory proof to the
State Comptroller that the County Treasurer made such payments into the
State treasury, and that such county had enacted an ordinance imposing
a dog license tax prior to April first, nineteen hundred and sixty-one.
Any county in which during the month of April, nineteen hun-
dred sixty, a dog warden was appointed and assumed office pursuant to
the provisions of § 29-184.2 of the Code of Virginia, shall be entitled to a
refund of the amount of payments made to the State Treasurer under
§ 29-206 of the gross receipts from dog licenses sold in such county during
the period from April one, nineteen hundred sixty, to December one, nine-
teen hundred sixty-one, inclusive. Such refund shall be made by the State
Treasurer, upon the warrant of the State Comptroller out of the Game
Protection Fund upon satisfactory proof to the State Comptroller that the
county treasurer made such payments into the State treasury, and that
such county had enacted an ordinance imposing a dog license tax subse-
quent to April one, nineteen hundred sixty.
2. An emergency exists and this act is in force from its passage.
