An Act to amend and reenact § 15-551.11 of the Code of Virginia which
was enacted by Chapter 248, Acts of Assembly, 1950, relating to the
exception of certain counties from the operation of certain Code
sections relating to county executive secretaries, and to provide fora
referendum.

Be it enacted by the General Assembly of Virginia:
1. That § 15-551.11 of the Code of Virginia, which was enacted by
pnapter 248, Acts of Assembly, 1950, be amended and reenacted as
ollows:
§ 15-551.11. (a) If any section, or part of section, of the ten preced-
ing sections is hereafter held by any court of competent jurisdiction to be
unconstitutional, such decision shall in no wise affect or render void the
remainder of such ten preceding sections, provided such sections shall not
apply to the counties of * Northampton, Caroline, Essex, King and Queen,
and Norfolk.
(b) §§ 15-551.1 through 15-551.10 shall not become effective in the
county of Accomack unless two hundred qualified voters in such county
shall petition the circuit court or the judge thereof in vacation for a refer-
endum on the question submitted hereinafter. Whenever such petition shall
be filed in such county, such court or judge shall by order entered of
record require the judges of election, on the day fixed in the order, not less
than thirty days from the date of such order, to open the polls and take
the sense of the qualified voters of the county on the question submitted
as hereinafter provided for. The ballots to be used shall be printed as
follows:
“May the county of Accomack have an executive secretary, as pro-
vided in §§ 15-551.1 through 15-551.10 of the Code of Virginia?”

The election shall in all respects be held as provided in § 24-141 of
the Code of Virginia.
If the result of the election held as provided herein be for the question
herein submitted, then the provisions of §§ 15-551.1 through 15-551.10
shall be effective in the county of Accomack.
