CHAPTER 379
An Act to amend and reenact §§ 17-221.1, 17-221.2, 17-221.3, 17-221.4,
17-221.5, 17-221.7, 17-221.8, 17-221.10 and 17-221.18, as severally
amended, of the Code of Virginia, relating to the courts of the city
of Newport News and the judges and clerks thereof; and to repeal
§§ 17-221.9, 17-221.11, 17-221.12 and 17-221.14 as amended, of the Code
of Virginia, relating to the same matters.

Be it enacted by the General Assembly of Virginia:
1. §§ 17-221.9, 17-221.11, 17-221.12 and 17-221.14 as amended, of the
Code of Virginia are repealed.
2. §§ 17-221.1, 17-221.2, 17-221.8, 17-221.4, 17-221.5, 17-221.7,
17-221.8, 17-221. 10 and 17-221. 13, as severally amended, of the Code of
Virginia are amended and reenacted as follows:
§ 17-221.1. There shall be for the City of Newport News the following
courts:
(1) The Corporation Court of the City of Newport News.
(2) The Circuit Court of the City of Newport News.
(3) The * Hustings Court of the City of Newport News, in this
chapter referred to as Hustings Court.
The provisions of this chapter relating to the * Hustings Court*
shall not be effective, nor shall such court be created until July one, nineteen
hundred * sixty-two. All matters pending in the Corporation Court of
the City of N ewport News, Part Two, shall be and are hereby transferred
to, and proceed in, the Hustings Court as of such date.
The Judge of the Corporation Court of the City of Newport News,
Part Two, shall be judge of the Hustings Court and shall serve as such
with like effect as uf elected judge thereof. His term as judge of such latter
court shall run through the term for which he was elected judge of such
former court.
§ 17-221.2. The Corporation Court, Hustings Court, and the Circuit
Court, * and the judges thereof, respectively, shall have the same power
as a circuit court or a circuit judge to admit to bail and award injunctions
and likewise the same jurisdiction of proceedings by writ of habeas
corpus, writ of quo warranto or information in the nature of a writ
of quo warranto, writ of mandamus and writ of prohibition.
§ 17-221.3. Appeals, writs of error, and supersedeas from and to
judgments of the Corporation Court, Hustings Court, Circuit Court,
* and the judges thereof, respectively, shall be taken and ‘allowed, as from
and to judgments, decrees and orders of a circuit court or judge.
§ 17-221.4. There shall be a clerk of the Corporation Court*. There
shall be a clerk of the * Hustings Court who shall be the clerk of the Circuit
Court *. Each clerk shall be elected by the qualified voters of the city on
the first Tuesday after the first Monday in November of the last year
of the term for which he was elected or appointed for terms of eight
years to commence on the first day of February of the year following
their election. Each such clerk shall be paid a salary out of the treasury of
the city of Newport News of not less than * twelve thousand dollars *
per annum, as the governing body of the city of Newport News may de-
termine. Such salary shall be in lieu of the retention by any such clerk of
any fees or emoluments received by him in execution of this office. *
The clerk who was elected clerk of the Corporation Court, Part Two
shall be deemed to be, and shall serve as, the clerk of the Hustings Court
and the Circuit Court, respectively. The clerk who was elected clerk of the
Corporation Court and the Circuit Court shall be deemed to be, and shall
serve as, the clerk of the Corporation Court. The terms of such incumbents
shall continue for the terms for which they were elected.
§ 17-221.5. The Corporation Court of the City of Newport News
shall have all jurisdiction and powers which are, or may be conferred by
general law on circuit or corporation courts, subject to the limitations of
this chapter.
Such Court shall have exclusive jurisdiction of the probate and
recordation of wills and, except as otherwise provided in this chapter, of
the appointment and qualification of fiduciaries.
§ 17-221.7. Within the corporate limits of the city, the Circuit Court
of the City of Newport News shall have concurrent jurisdiction with the
Corporation Court and Hustings Court of the city, except * the probate
and recordation of wills and the appointment and qualifications of fi-
duciaries, save when it may be necessary to appoint a fiduciary in the
progress of a suit pending in such court. *
§ 17-221.8. The judge of the eleventh judicial circuit shall be the
judge of the Circuit Court of the City of Newport News, * until July one,
nineteen hundred sixty-two; thereafter the judge of the fortieth judicial
circuit shall be the judge of such court.
§ 17-221.10. Within the corporate limits of the city, the * Hustings
Court of the City of Newport News shall have concurrent jurisdiction with
the Corporation Court and the Circuit Court of the city as to all matters,
cases or proceedings of any nature, * except the probate and recordation
of wills and the appointment and qualifications of fiduciaries, save when
wt may be necessary to appoint a fiduciary in the progress of a suit pending
in such court.
§ 17-221.13. Within the corporate limits of the city, the * Hustings
Court of the City of Newport News, shall have:
(1) * Exclusive jurisdiction of the docketing of abstracts of judg-
ments from other Courts and United States Tax Liens.
*(2) Exclusive jurisdiction of the recordation in the mode prescribed
by law of deeds and other papers required or authorized by law to be
recorded ;
(3) Concurrent jurisdiction with the Corporation Court and Circuit
Court of all proceedings for the condemnation, for public use, of any land
or property within the corporate limits of the city;
(4) Concurrent jurisdiction with the Corporation Court and Circuit
Court of the city of all motions to correct erroneous assessments on real
estate within the corporate limits of the city;
(5) Concurrent jurisdiction with the Corporation Court and Circuit
Court of the city of all suits and proceedings in chancery cognizable by
law in the circuit courts of the Commonwealth;
(6) Concurrent jurisdiction with the Corporation Court and Circuit
Court of the city of all common law cases; and
(7) Concurrent jurisdiction with the Corporation Court and Circuit
Court of the city of all appeals allowed by any State law or ordinance of
ae city from the judgments of the municipal courts * or Courts not of
ecord.
3. An emergency exists and this act is in force from its passage.
