An Act to amend and reenact § 7 of Chapter 57 of the Acts of Assembly of
1940, approved February 20, 1940, which provided a new charter for
the town of Wise, relating to the town council, its composition and
providing for vacancies.

Be it enacted by the General Assembly of Virginia:
i. That § 7 of Chapter 57 of the Acts of Assembly of nineteen hundred
‘orty, approved February twenty, nineteen hundred forty, be amended and
reenacted as follows:
§ 7. * That the council of the town of Wise shall consist of five
nembers who shall be residents and qualified voters of the town of Wise,
ind that on the second Tuesday in June, nineteen hundred sixty-three,
‘here shall be a general town election at which there shall be elected five
‘ouncilmen. The two councilmen, each of whom has received more votes
n said election than any of the other members shall serve as members
f the council for terms of four years each. The remaining three members
shall serve for a term of two years each. On the second Tuesday in June,
rineteen hundred sixty-five, and on the second Tuesday in June each four
years thereafter there shall be a general town election at which there
shall be elected three councilmen, each for the four year term aforesaid,
ind on the second Tuesday in June, nineteen hundred sixty-seven, and on
the said day each four years thereafter there shall be general town
elections at which there shall be elected two councilmen, each for the four
year term aforesaid. The council shall be a continuing body and no measure
pending before such body shall abate or be discontinued by reason of expi-
ration of * term of office or removal of any of the members *. Vacancies
in the council shall be filled within thirty days after such vacancy occurs
for the unexpired term by a majority * of the remaining members. *
2. An emergency exists and this act is in force from its passage.
