Virginia, relating to killing of deer that are damaging crops or creat-

[H 394]
Approved March 10, 1962
Be it enacted by the General Assembly of Virginia:
1. That § 29-145.1, as amended, of the Code of Virginia, be amended and
reenacted as follows:
§ 29-145.1. Whenever it is found that deer are damaging fruit trees
or crops in the State, the owner or lessee of the lands on which such dam-
age is done shall immediately report such fact to the local game warden for
investigation. If after investigation the game warden finds that deer have
so injured the fruit trees or crops of such owner or lessee as to cause dam-
age, he shall authorize the owner or lessee to kill such deer when they are
found upon his premises and in the act of further injuring such trees or
crops.
Whenever it is found that deer are creating a hazard to the operation
of any aircraft or to the facilities connected with the operation of aircraft,
the person or persons responsible for the safe operation of such aircraft
or facilities shall report such fact to the local game warden for investiga-
tion. If after investigation the game warden finds that deer have so created
such hazard, he shall authorize such person or persons, or their representa-
tives, to kill such deer when they are found to be creating such a hazard.
The carcass of every deer so killed shall be delivered by the owner or
lessee to the local game warden, * who shall deliver it to such charit-
able institution or hospital as designated by the Commission of Game and
Inland Fisheries; provided, however, that * any deer so killed in any
year shall, upon request, be awarded by the game warden to the owner
or lessee, who shall give such person a certificate to that effect on forms
furnished by the Commission of Game and Inland Fisheries. Any person
awarded a deer under this section may make use thereof as if the same had
been killed by him during the season therefor.
